AN ORDINANCE REGULATING THE USE OF ELECTRIC SCOOTERS OR E-

SCOOTERS IN THE CITY OF VALENZUELA AND PROVIDING PENALTIES FOR
VIOLATION THEREOF.

WHEREAS, Section 16 of the Local Government Code states that:

“Section 16. General Welfare. – Every local government unit shall exercise the
powers expressly granted, those necessarily implied therefrom, as well as
powers necessary, appropriate or incidental for its efficient and effective
governance, and those which are essential to the promotion of the general
welfare. x x x;”

WHEREAS, electric scooters are becoming popular alternative mode of

transportation and currently serve as private vehicle by residents of Valenzuela City.

WHEREAS, there is a need to regulate use and operation of e-scooters to protect

and promote public safety and ensure welfare of residents, transients and traversing
public of Valenzuela City.

NOW THEREFORE, be it ORDAINED as it is hereby ORDAINED by the City

Sangguniang Panlungsod of Valenzuela in a session duly assembled the following:

SECTION 1. TITLE. This ordinance shall be known as the “2020 E-Scooter

Ordinance of Valenzuela City”.

SECTION 2. SCOPE. This ordinance shall be applicable to all electric scooters

operating or traversing within Valenzuela City.

SECTION 3. DEFINITION OF TERMS. The words and phrased used in this

ordinance are hereby defined as follows:

a. Electric Scooter or E-Scooter – A stand-up vehicle powered by electric motor

which is designed to travel on two or three wheels. Classified as a micromobility,
this scooter is generally designed with handlebars and a large deck in the center
on which the rider stands.

SECTION 4. USE OF PROTECTIVE GEARS. No person shall be allowed to ride

an e-scooter without wearing helmet, knee pads and elbow pads.

SECTION 5. BAN ON MAC ARTHUR HIGHWAY. All e-scooters are allowed

to traverse in all roads, streets, alleys within the jurisdiction of Valenzuela City.
However, all e-scooters shall not be permitted to traverse along Mac Arthur Highway.

Section 6. ADMINISTRATIVE PENALTY – Any violation of this ordinance

shall be meted with the following administrative penalties:

Nature of Offense Fine

1st Offense One Thousand Pesos (Php 1,000.00)
2nd Offense Three Thousand Pesos (Php 3,000.00)
3rd Offense Five Thousand Pesos (Php 5,000.00)

Section 7. SEPARABILITY CLAUSE. If for any reason, a part of this Ordinance

is declared illegal or invalid, other parts or provisions hereof which are not affected
thereby shall remain valid and in full force and effect.

Section 8. REPEALING CLAUSE. All previous Ordinance and rules/regulations

which are inconsistent with the provisions of this ordinance hereby deemed, modified
or repealed accordingly.

Section 9. EFFECTIVITY CLAUSE. This ordinance shall take effect immediately

upon approval.
