1991 omnibus rule implementing book v of EO 292


Rule XV1, Section 42. Public officials and employees on extended service are entitled to 15 days vacation and 15 days sick leave
annually subject to the following guidelines:
a. Leave credits earned on extended service are non-commutative. Thus, unused leave credits may not be converted to
their corresponding money value;
b. Leave credits earned on extended service are non-cumulative hence, unused leave credits within the year may not be
carried over to the succeeding years;
c. Executive Order 1077 dated January 9, 1986 and other laws on leave are applicable to officials and employees on
extended service insofar as they are not inconsistent with the preceding guidelines.

Rule X111, Section 12. No person who has reached the compulsory retirement age can be appointed to any position in the
government, except to primarily confidential position, provided that the appointment shall be under temporary status.
The commission however may in meritorious cases, extend the services of one who has reached the compulsory retirement age
of 65 for a period of six months renewable for another six months. However, services rendered during the period of extension
shall not be credited as part of government service. Likewise such extension shall not entitle the employee to leave credits and
other benefits.

previously issued MCs.
Rule XV1, Section 42. Employee on extension service does not earn leave credits. The officials/employee who has reached the
compulsory retirement age of 65 but whose services has been extended by the commission for another six months, no longer
earn leave credits.

A person appointed to a coterminous/primarily confidential position who reached the age of 65 years is considered
automatically extended in the service until the expiry date of his appointment or until his services is earlier terminated. Thus, a
coterminous/primarily confidential employee is also entitled to the sick and vacation leave credits subject to the rules provided
