SUB: - NOTICE WITH REFERENCE TO THE BREACH OF

CONTRACTUAL OBLIGATIONS

Dear Sir,

1. Under instructions and on behalf of our Client Mrs T. Kamjila

Yimchunger I do hereby serve you with the following notice: -

2. That you the Noticee had forcefully entered into a divorce agreement
wherein with effect from 29th January, 2016 you the Noticee had stated
that whatever properties/belongings etc. accumulated out of the wedlock
would be given to our client.

3. That In the terms of the said agreement it had also been specifically
stated that all the pending bills of the Shamator GA rest house shall be
withdrawn by our client and out of the said bill all the shop dues shall be
paid by our client.

4. That it had come in the notice to my client that you have breached the
contract in the following manner:-

1. You the Noticee had intentionally cheated my client by giving her

false statement, thus prompting her to sign on the divorce
agreement.
 2. You the notice did not disclose the withdrawn amount at the time
of executing the said agreement and thus my client has been
deceived.

3. You the Noticee had withdrawn the amount unprocedurally, by

conniving with the department officials, further violating the norms
and procedure of the contract agreement.

4. That our client acknowledging the divorce agreement had fully put
her trust in the said agreement wherein you the notice had taken
advantage by misusing the agreement deed to your advantage.

5. That you the Noticees while committing the preceding acts have
committed cheating and dishonestly inducing delivery of property by
making her sign the divorce agreement.

6. That my client had further made endeavours in resolving the issue but
you the Noticees were hardly interested in resolving the present issue
rather tried to make it more complicated by your dishonest intentions
and thus refused to sort the same.

7. That due to your illegal acts by not fulfilling your words,

mismanagement, mis-commitment and negligence our client suffered
mental agony, mistrust and also suffered financial loss which were
occurred due to the act of you the Noticee.

8. That our client is demanding special damages on account of mental

torture, agony, financial loss due to you which you have made in last
Days.

9. That through instant legal notice, you are hereby advised to pay the
Consultancy amount of Rs. /- to our client along with
unconditional apology within 7 days after the issuance of instant legal
notice otherwise, our client has positively instructed to sue against you
(to recover the principal amount along with special damage) in the Court
of Law at your risk and costs and has given clear instructions to file civil
as well as criminal proceedings against you in the competent court of law
and in that event you shall be fully responsible for the same.

10. A copy of the present Notice is duly retained by our office, for records
and future action.
