OF
DOLO H. INCIDENTE

This Judicial Affidavit of Dolo H. Incidente is executed to serve as her direct

testimony in the instant case.
I, Dolo H. Incidente, single, and living at 60 Real St., Tacloban City, a witness
in this case, after having been sworn to in accordance with law, hereby
depose and state:

PRELIMINARY STATEMENT

The person examining me is ATTY. XANDER L. YU with Office Address

at RTR Building Brgy. Pawing, Calanipawan, Tacloban City. The examination
is being held at the same address. I am answering his questions fully
conscious that I do so under oath and may face criminal liability for false
testimony and perjury.

OFFER OF TESTIMONY: This affidavit/testimony of witness Dolo H.

Incidente is being offered to prove that she is an eye witness to the crime
of homicide. She will testify that she was there when the accused, with
intent to kill, did then and there willfully, unlawfully and feloniously attack,
assault and use personal violence upon one Marla D. Makaawa, with the
use of a piece of wood, thereby inflicting upon him blunt traumatic injuries
which directly caused her death on October 2, 2020. She will identify the
accused in open court as the person who committed the crime.

 Questions asked of the witness are as follows:
1. Q. Ms. Witness, please tell the Honorable Court your name, age and
other personal circumstances.
A. I am Dolo H. Incidente, 27 years old, and a Filipino. I am single and
a resident of 60 Real St., Tacloban City. I am the proprietor of Suki
ng Bayan Convenience Store.

2. Q. Do you know why you are here?

A. Yes. I am here because I am a witness to the killing of Marla D.
Makaawa.

3. Q. Where were you last October 1, 2020 at about 2 o’clock in the

afternoon?
A. I was about to go out of Suki ng Bayan Convenience Store located
at 60 Real St., Tacloban City, when I saw a commotion happening
nearby.

4. Q. Where is this commotion happening?

A. It is outside, in front of my store.

5. Q. What did you saw during the commotion?

A. I was about to open my glass door when I saw Dina C. Marikit pick
up a piece of wood and attacked Marla D. Makaawa in different parts
of her body causing her to fall and cry in pain.

6. Q. What happened next, if any?

A. I saw Marla D. Makaawa already lying down on the ground while
Dina C. Marikit run and fled the scene.

7. Q. Who is this Dina C. Marikit and Marla D. Makaawa?

A. Dina C. Marikit is the person who killed Marla D. Makaawa.

8. Q. Do you know Dina C. Marikit and Marla D. Makaawa?

A. Yes.

9. Q. How did you know them?

A. They are my neighbors. Dina C. Marikit is living near Marla D.
Makaawa’s house on the same street, Real St., Tacloban City, few
blocks away from my store.

10.Q. What did you do after?

A. Before going outside, I asked my cashier, Mea I. Culpa, to call the
police. I hurriedly run to help Marla D. Makaawa but she is
already unconscious. So I waited until help arrives.

11.Q. What happened next, if any?

A. The ambulance and some police came. They take Marla D.
Makaawa and I to the hospital.

 12.Q. What happened in the hospital?
A. She suffered blunt traumatic trauma with injuries and was set for
operation. It was discovered that she sustained internal bleeding.
However, she suffered heart attack during the operation.

13.Q. Did you know what happened next?

A. Yes, she died.

14.Q. Do you have anything to state?

A. None.

I, XANDER L. YU, hereby attest that I faithfully recorded the questions

propounded and the corresponding answers given by the witness DOLO H.
INCIDENTE. I duly interpreted the questions I asked in Waray-waray dialect
which the witness understands and she provided the answers the best way
she could which were duly translated by me in the ENGLISH language. I did
not in any way coach or taught or instruct the witness on how to answer or
any other person or persons then present or assisting the witness regarding
the latter’s answers.
