EXTRA-JUDICIAL SETTLEMENT of ESTATE WITH WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS: 

We, Marlina Rosal-Calamba, Rodulfo Rosal, Ramil Rosal, Lorna Rosal-Cabales, Aida
Rosal-Terado, Rolando Rosal and Cheryl Rosal-Potolin, all Filipinos, of legal ages, and all residents
of Brgy. Catuogan, Bontoc, Southern Leyte.

Witnesseth:

     That we are the sole legal heirs of the late Rodrigo Rosal, who died long time ago at Brgy.
Catuogan, Bontoc, Southern Leyte; That during his lifetime, a real property co-owned by his siblings
was declared in his name, situated at Brgy. Catuogan, Bontoc, Southern Leyte, more particularly
described as follows, to wit:

“BRIEF DESCRIPTION of the whole LAND”


(TD No. 07-02-0010-00038)

“A parcel of agricultural land situated at Brgy. Catuogan, Bontoc, Southern Leyte;


Covered by Tax Declaration No. 07-02-0010-00038, with Lot No: 5672, Declared in the
name: RODRIGO ROSAL, bounded on the North: Lot No: 5657, on the East: Lot No.
5673, on the South: Lot No: 5671, and on the West: Lot No: 5660, Consisting of Eighteen
Thousand Eight Hundred Forty One Square Meters, (18,841 SQM)”

That pursuant to Rule 74 of the Rules of Court, the parties have adjudicate unto themselves the
portion meant for our predecessor, Rodrigo Rosal in the above-described real property in equal share.
That no personal property is involved in this instrument and to the best of our knowledge and belief, the

decedent left of debts;
no will or estate with waiver of rights (Rodrigo Rosal) 1

That during the lifetime of Rodrigo Rosal, they siblings had orally partitioned the above
described property in five portions equally, and had cultivated their respective portions;

That we hereby WAIVE AND RENOUNCE voluntarily whatever rights or interest we have
therein in the abovementioned portions of land in favour to the siblings of Rodrigo Rosal, namely:
Zosimo Rosal, Zosima Rosal-Ansano, Juanita Rosal, Conchita Rosal-Apolinar, all Filipinos, and
residents of Brgy. Catuogan, Bontoc, Southern Leyte. Per siblings, has an area of Three Thousand Seven
Hundred Sixty-Eight Square Meters (3,768 SQM);
