RESOLUTION No. 2017 - 077

A RESOLUTION AUTHORIZING THE MUNICIPAL MAYOR, HON. REY P. GRABATO, TO SIGN A
DEED OF DONATION OF LOT NO.2172 WITH TCT-OCT 1004, FROM MUNICIPALITY OF MINA TO
THE NAME OF MINA CENTRAL SCHOOL

WHEREAS, the Universal Declaration of Human Rights recognizes education as a

fundamental right necessary for the growth of an individual and the development of society;
WHEREAS, Sec. 1, Article XIV, of the 1987 Constitution of the Philippines provides, The
State shall promote the right of all citizens to quality education at all levels of education and
shall take appropriate steps necessary to make such education accessible to all;
WHEREAS, the Department of Education in its DepEd Memorandum DM-LA/STO-2016
dated December 12 2016 of Atty. Alberto Muyot, DepEd Undersecretary of Legal Affairs,
mandated in ensuring access to quality basic education for all Filipino learners, and there is a
need to safeguard the interest of existing school sites from being subjected to disposal, sale,
lien, or encumbrance and against reconveyance suits and claims for payment from private
entity/individual or heirs of donors;
WHEREAS, the DepEd requires the titling of all the existing school sites donated to
DepEd which was not yet officially transferred in the name of the Department;
WHEREAS, , the Mina Central School is in possession of the Lot No. 2172 with TCT-OCT
1004 for approximately 101 Years;
WHEREAS, the Local Government Unit of Mina and DepEd Mina collaborate their effort
to further develop the local public school system, to protect the interest of the public basic
education, and uplift the quality of education to its constituents;
WHEREAS, an authority to sign and execute expropriation proceedings by the Municipal
Mayor from this Sanggunian is a requirement pursuant to R.A. 7160, otherwise known as the
Local Government Code.
NOW, THEREFORE:
BE IT RESOLVED by the Sangguniang Bayan of Mina, Province of Iloilo to pass a RESOLUTION
AUTHORIZING THE MUNICIPAL MAYOR, HON. REY P. GRABATO, TO SIGN A DEED OF DONATION OF
LOT NO. 2172 WITH TCT-OCT 1004, FROM MUNICIPALITY OF MINA TO THE NAME OF MINA CENTRAL
SCHOOL.
ADOPTED this 15th day of June 2017, on motion of Hon. Rose Kareen S. Defensor duly seconded
by Hon. Jose G. Salanio Jr..
