GENERAL CONDITIONS OF CONTRACT

S.No Description

1 The rates shall remain firm and fixed till the whole of the assigned job is completed in all respects and no escalation whatsoever is admissible in this
regard.

2 The Quantities mentioned in the BOQ are tentative and may vary to any extent. The payment shall be released for actual quantities certified by the
Engineer-in-charge.

3 You shall abide by all rules and regulations of all acts of Government /Local body /statutory authorities pertinent to the execution of this contract.
KMV shall not be responsible for non-adherence of statutory requirements on your part.

4 'Income Tax(TDS)' at the prevailing rates as applicable from time to time shall be deducted from your bills as per statutory norms. Any other statutory
levies shall be to your account, unless otherwise stated.FSD / Retention Shall be Kept under hold as Per KMV Norms.

5 All expenses towards mobilization at site and demobilization including bringing in equipment, work force, materials, erection and demolition of
equipment, clearing the site etc.shall be deemed to be included in the rates payable to you and no separate payments on account of such expenses
shall be entertained(Not Applicable for Labour Contracts).

6 Water & electricity, if provided by us at free of cost, shall be at a single location of the Project and you shall be required to extend the facility to your
place of work at your own cost(Not Applicable for Labour Contracts).

7 Any work not confirming to the execution drawings, instructions, specifications or codes shall be rejected forthwith and you shall carry out the
rectifications at your own cost. It shall be made good by the Engineer-in-charge at your risk and cost by engaging a third party in case of your inability
to attend and rectify the defect within the period specified(Not Applicable for Labour Contracts).

8 If the Engineer-in-charge feels at any time that you are not executing the works inline with the stipulated time schedules, he shall have full authority
to cancel the part/full workorder and get the balance works executed by engaging other agencies at your risk and cost.

9 Registered Vendors: GST shown in the WO shall be released only upon submission of GST return copies of respective RA Bill
Non-registered vendors: The rates shown in the WO are inclusive of all taxes & levies and the vendor is solely responsible to discharge all the dues
arise out of this WO.

10 The quantities shown under 'Scope Statement/BOQ' in the 'Work Order' are approximate and are liable to vary to any extent and any variation shall
not entitle you to any escalated rates in respect of any item of work.

11 You shall adhere to safe construction practices and guard against hazardous and unsafe working conditions to full satisfaction of the Engineer-in-
charge. KMV shall in any event not responsible for the safety of your Equipment, Employees and Workment.

12 In the event of any accident causing injury resulting into partial or total disability or even causing death, you shall be totally responsible and shall
absolve KMV from all damages or expenses related to it.

13 Any additional / extra items of work not covered under the 'Work Order' but become inevitable to be executed, as deemed necessary by the
Engineer-in-charge, shall be carried out by you on mutually agreed rates.

14 Free issue materials, if any, shall be issued free of cost at our 'Project Stores'. You have to make your own arrangements at your own cost for
shifting of the same to work location. You shall be solely responsible for proper storage, safe custody and proper accounting of the same
(Not Applicable for Labour Contracts).

15 If any of the conditions contained herein contradict with the 'Special Conditions of contract', the condition as stipulated in the 'Special Contitions of
Contract' shall prevail.

16 In case of any disputes regarding meaning and intent of any specifications, terms and conditions etc., the same shall be referred to the
Head-Contracts of KMV, whose decision shall be final and binding on both the parties.

17 Force majeure clause is applicable for this Work Order inline with the main Contract agreement with the Employer.

18 All disputes are subjected to the jurisdiction of Hyderabad, Telangana only

SPECIAL CONDITIONS OF CONTRACT

CONTRACT TERMS AND CONDITIONS :

1. You have to engage required man power and specified machinery & tools to
achieve the target given, in case of your failure, we shall reserve the right
to engage another contractor to execute the work at your risk and cost.
2. Your authorized person should be available at site during the course of work
3. Supply of diesel for machinery is in your scope.
4. Required safety measures to be strictly followed by your man power and
machinery. You are responsible for the safety of your work force and if any
accident occurs to your work men, you have to take care of the all incidental
charges and other mandatory expenses from your end.
5. You shall abide by all statutory requirements
6. KMV shall provide free accommodation to your operators & helpers at free of
cost, arranging food is in your scope.
7. No idling charges shall be payable in any circumstances
8. While dismantling existing BT Road, KMV shall provide bucket teeth for
excavator with a limitation of maximum one set per 1 KM upon joint inspection
of the condition of teeth.

Payment Terms :
a) Payment will be released within 30 days after certifications of bills by
KMV's representative.
b) The price is exclusive of Goods and Service Tax (GST)
c) An amount of 5% will be deducted on each running bill (Payment) towards
FSD and it will be paid after satisfactory completion of the entire work.
