A. RA 9173 was enacted in 2002 to provide a comprehensive definition and understanding of the
nursing profession. This is in recognition of the vital role nurses play in the delivery of quality
health services not only in the country, but all over the world.

1. Differentiate nursing malpractice and nursing negligence.

ANSWERS:

Negligence - is the failure to provide care as a reasonable person would to avoid harm to a
patient. For example, you would expect a nurse to provide care for his or her patients in order for
them to heal without further injury. Four elements are necessary to prove medical negligence has
resulted in an injury. The four elements are duty of care, breach of duty of care, cause of injury,
and some form of damages. Malpractice - is a type of negligence; it is often called "professional
negligence". It occurs when a licensed professional (like a doctor, lawyer or accountant) fails to
provide services as per the standards set by the governing body ("standard of care"),
subsequently causing harm to the plaintiff.
