AFFIDAVIT-COMPLAINT

I, JAKE ROXAS, of legal age, Filipino citizen, single, residing at

Brgy. Sta Clara, Batangas City, Batangas, after having duly sworn to
in accordance with law do hereby depose and say:

1. That I am the complainant in the above-entitled case;

2. That I am formally charging respondents Chris Macalalad

(Macalalad) and Antonio Magnaye (Magnaye), with postal
address at Brgy Sta Clara, Batangas City, Batangas, for the
crime of Slight Physical Injuries penalized under Art. 266 of the
Revised Penal Code, committed as follows, to wit:
a) THAT on or about August 15, 2020 at around 9 o’ clock in
the evening along Rizal Ave. in Batangas City while
looking for an open 7/11 store outlet, I came across
Macalalad and Magnaye who were both apparently drunk
at that time as they were walking in a swaying manner;

b) THAT when they approached me, Macalalad asked for a

cigarette which I was not able to give since I do not have
cigarette at that time;

c) THAT suddenly Macalalad punched me in the stomach

while Magnaye kicked me causing me to be out of
balance and fall on the ground hitting my left arm and
face in a concrete post;

d) THAT after seeing me fell, the two runaway and Jose

Manalo, a bystander, helped me and brought me to the
hospital. Copy of Jose Manalo’s Judicial Affidavit is
attached as Annex “A” hereof;

e) THAT I was brought to Batangas General Hospital to

have an examination of my swollen face, fractured finger
and the other injuries I sustained, and the doctor
recommended for a healing and rest period of nine (9)
days. Copy of the Medical certificate and Official Receipts
for the cost of hospitalization are attached as Annexes “B”
and “C” hereof;

f) THAT also, as a consequence of the aching body and

swollen face I was not able to report for work for nine (9)
days. Copy of my Certificate of Employment is attached
as Annex “D” hereof;

g) THAT on August 16, 2020, I filed a complaint before the

barangay, and after several hearings, no amicable
settlement was reached between the parties as evidence
the Certificate to File Action which is hereto attached as
Annex “E”.
 3. That I am executing this affidavit to attest to the truth of the
foregoing statements, and for the purpose of charging the
respondents for the crime of Slight Physical Injuries penalized
under Art. 266 of the Revised Penal Code.
