Review of the decision of the Court of First Instance


of Camarines Norte finding the defendants guilty
of multiple murder and damage to property and
sentencing them to the penalty of

death. This case has reference to that incident on


May 7, 1949, wherein a plane of the Philippine Air
Lines, while winging its way to Manila from Daet,
was disabled by an explosion in its hindi part and,
falling into the sea near Alabat Jsland of the
southeast coast of Luzon, disappeared in deep
water together with its passengers and cargo,
resulting In the death of 13 persons. The appellants
are guilty as charged. Appellant Crispin Verzo must
be held as principal, it appearing that it was he who
had the time bomb loaded into the plane.
Appellants Amadeo Salazar and Gavino Largo are
guilty only as accomplices, because, although they
cooperated in the execution of the criminal act with
knowledge that something illicit or forbidden was
being done, there is no evidence that they knew
that the act would, or was intended to cause, the
destruction of the plane and its passengers.
Appellant Crispin Verzo is sentenced to suffer the
penalty of death in the manner provided by law;
and the appellants Amadeo Salazar and Gavino
Largo, who are not entitled to the benefits of the
Indeterminate Sentence Law because the first is a
habitual delinquent and the second has escaped
from confinement, are, as accomplices, sentenced to
17 years and 4 months of redusdon tetmporal. In
addition, the three appellants are sentenced to pay
indemnity to the heirs of each of the deceased.
Crispin Verzo, as principal, shall be required to
indemnify the heirs of each of the deceased in the
amount of P6,000, and in case of insolvency, his two
co-appellants shall be jointly and severally liable
secondarily for the said amount. Amadeo Salazar
and Gavino Largo, in the character of accomplices,
shall be jointly and severally liable for the same
amount, and for such amount, in case of their
insolvency, the principal Crispin Verzo shall be
secondarily liable. (Art. 110, Revised Penal Code;
People vs. Bantagan, 54 Phil., 834.)
Modified accordingly, the sentence below is
affirmed, with costs. Per Curiam.
