JUDICIAL AFFIDAVIT
OF
FR. ALEXANDER BAGO

This Judicial Affidavit of Fr. Alexander Bago is executed to


serve his direct testimony in the instant case.

I, Fr. Alexander Bago, the Parish Priest of Aglipayan Church at


Lallo Cagayan, witness in this case, state under oath as follows:

PRELIMINARY STATEMENT

The person examining me is Atty. Divine Grace P. Berbano with


office address at #05 ABC Bldg., Centro 1, Appari Cagayan. The
examination is being held at the same address. I am answering her
questions fully conscious that I do so under oath and may face
criminal liability for false testimony and perjury.

PURPOSE: This affidavit/testimony of witness Fr. Alexander Bago


is being offered to prove that the wedding of plaintiff Tina Israel and
plaintiff, Joel Israel, was celebrated at Gattaran, Cagayan on April 28,
2001without a marriage license but it was only registered on
September 8, 2001 and to prove that the couple did not make a vow
to take each other as husband and wife.

1. Q: Please state your name and other personal circumstances for


the record.
A: I am Fr. Alexander Bago, the Parish Priest of the Aglipayan
Church at Lallo Cagayan.

2. Q: Do you know why you are here?

A: Yes, because I am one of the witnesses.

3. Q: Do you know Ms. Tina Israel?

A: Yes, attorney.

4. Q: Have you met her personally?

A: Yes, attorney.

5. Q: How about Mr. Joel Israel, do you know him?

A: Yes, maam.

6. Q: What is your relationship or connection with Mr. and Mrs.


Israel?

A: I was the one who solemnized their marriage.

7. Q: Is Mr. and Mrs. Cruz members of the Aglipayan Church?

A: No, they are not attorney.

8 Q: Where were you at 6:00 pm of April 28, 2001?

A: I am at Gattaran, Cagayan preparing for the celebration of the


Marriage of Mr. and Mrs. Israel.

9. Q: Where in particular did you solemnize the marriage?

A: At Centro Sur, Gattaran, Cagayan attorney.

10. Q: And you are designated as Parish Priest of?

A: Aglipayan Church at Lallo Cagayan.

11. Q: Do you have authority to solemnize marriage?

A: Yes, I applied for my license on February 1990.According to


my license, I can solemnize marriage in Lallo, Cagayan.
12. Q: What do you usually require before celebrating marriages?

A: I usually require Valid Marriage License, baptismal certificate


and birth certificate of the couple.

13. Q: Where do you usually solemnize marriages?

A: At our church, at the homes of the couples, at hotels or


beaches.

14. Q: Do you ask the same when the marriage is solemnated at


your church and when it is celebrated in other places?

A: No maám, I also require a notarized written request to


celebrate the marriage outside the church.

15. Q: Were the parties in this case able to present the needed
documents before the April 28, 2001 wedding?

A: No, maam

16. Q: Who were with you at the venue of the wedding on April 8,
2018?

A: Ms. Tina Israel and Mr. Joel Israel, and their parents with 5
principal sponsors and visitors maám.

17. Q: What did you do at the venue?

A: I celebrated the marriage of the couple maám.

18. Q: What happened next?

A: I ask the couple to sign a blank marriage certificate and the


sponsors to sign at the back of the marriage certificate.

19. Q: What did you do with the marriage certificate after?

A: I kept it on my briefcase.

20. Q: What happened next?

A: I instructed the couple to secure a Marriage License at the


Local Civil Registrar.
21. Q: Where were you on September 8, 2001?

A: I am at my office in Lallo, Cagayan.

22. Q: What happened on that day?

A: The marriage license of the parties arrived.

23. Q: Did you celebrate a marriage of the parties at this date?

A: No, maám.

24. Q: What happened after receiving their marriage license?

A: I filled up the Marriage Certificate of the parties.

27. Q: Do you recognize this particular marriage contract?

A: Yes attorney. It was the marriage contract I prepared for Mr.


and Mrs. Israel.

28. Q: Can you read the date and place of celebration indicated in
the marriage contract you prepared?

A: September 8, 2001 at Lallo Cagayan.

29. Q: Did you celebrate the marriage of Mr. And Mrs. Israel on
September 8, 2001 at Lallo, Cagayan?

A: No, maam.

30. Q: Can you tell us why the contract indicated a different date
and place of celebration?

A: Yes, maam. At the time of the celebration on April 28, 2001


there was no Marriage License. It was only subsequently
issued on September 8, 2001. I made it appear that it was
celebrated at Independent Church of Filipino Christians because
they did not give me written authority to celebrate marriage at
their home

2020 at #05 ABC Building, Centro 1, Aparri, Cagayan. I have
identified affiant through driver’s license bearing No. N15-82-73987 
issued at Tuguegarao City on February 16, 2020 bearing his
photograph and signature.

ATTESTATION

I, Atty. Divine Grace Berbano, of legal age, Filipino, and with


office address at #05 ABC Building, Centro 1, Aparri, Cagayan, under
oath and state that:

1. I personally conducted the examination of witness, Fr.


Alexander Bago, on August 2, 2020 in connection with the
above-captioned case.

2. I faithfully recorded or caused to be recorded the questions


that I asked and the answers that the witness gave as
stated in his judicial affidavit.
3. Neither I nor any other person present or assisting the
witness coached him regarding his answer stated in his
Judicial Affidavit.
