Dear MR. BANAAG:

This letter is to inform you of the relevant laws that could be applied in the case involving the incident
where Mr. Sison’s dog bit your daughter, Mary Banaag.

The laws that are relevant in this case can be found in the Civil Code provisions regarding Extra-
contractual Obligations. Article 2183 of the Civil Code states that a possessor of an animal or whoever
may make use of the same is responsible for the damage which it may cause and such responsibility shall
only cease if the damage should come from force majeure or from fault of the person who has suffered
the damage.

It is also stated in Article 2202 of the Civil Code regarding quasi-delicts that a person shall be liable for
all damages which are the natural and probable consequences of the act or omission complained of. In
addition to that, Article 2217 in relation to Article 2219 of the Civil Code states that moral damages may
be recovered in quasi-delicts as long as physical suffering, mental anguish, fright, serious anxiety,
besmirched reputation, wounded feelings, moral shock, social humiliation, and similar injury are caused
to the victim.
