LOAN AGREEMENT UNDER “CONSUMER CREDIT SCHEME”

The agreement is made at …………………………. this …………. day, of…………. ……………. between
Standard Bank Limited, a Banking Company incorporate in Bangladesh under the Companies Act. 1994 and
having its registered office at Metropolitan Chamber Building, 122-124, Motijheel C/A, Dhaka-1000
Bangladesh with one of the Branch is situated at South Plaza, 235, Shahid Muktijoddah Sarak, Chandpur,
Bangladesh (hereinafter referred to us the “Bank”). (Which expression unless there is anything repugnant in
the subject of context shall be deemed to mean and include its successors in interest and assigns) of the one
part:

(Hereinafter referred to as the “Client”) of the other part:

Whereas:

i. The Client has requested the Bank to procure Household durable Articles described fully in
the schedule hereto (hereinafter referred to as the “Assets”) and has proposed to buy the same at a
total price of Tk. 5,50,000/= (Taka Five Lac Fifty Thousand) only with the assistance of loan facility
under “Consumer Credit Scheme” of the Bank.
ii. The Bank has accepted the proposal of the Client and has sanctioned a loan of Tk
5,50,000/= (Taka Five Lac Fifty Thousand) only on the terms and conditions stipulated in the
Credit Sanction Advice no. ____ ________________ dated________________________ which
has duly been accepted by the Client.

NOW THEREFORE, THIS AGREEMENT WITNESSETH AS FOLLOWS:

1. That, on the request of the Client the Bank has purchased / procured or shall purchase / procure the
Assets described in the schedule hereto and the Client has proposed to buy the same Assets against Bank
loan under Consumer Credit Scheme at a price of Tk. 5,50,000/= (Taka Five Lac Fifty Thousand) only
and the Bank has agreed as proposed.
2. That, the client agrees to pay a sum of Tk. 5,50,000/= (Taka Five Lac Fifty Thousand) only being his/her
equity as down payment towards payment of price of the Assets before procurement to the Bank.
3. That, the Client hereby undertakes to pay the Bank loan amount of Tk. 5,50,000/= (Taka Five Lac Fifty
Thousand) only within 60 months on monthly installment basis @ Tk. 11,155/= along with of service
charge and risk fund of the Bank against credit facilities sanctioned favoring the Client for procurement
of Customer Loan under its Consumer Credit Scheme.
4. That, the Client undertakes that in case of failure to pay the aforesaid dues to the Bank as per schedule,
the Bank may take appropriate action to recover the dues from the guarantor(s), successor(s) of the
Client or may approach his employer as Bank deems suitable.
5. That as and by way of security for payment of the total price the Client shall create Hypothecation of
said Assets in favor of the Bank and also furnish such other securities as the Bank may from time to time
require.
6. That, the Client shall not defer deposit of installments as aforesaid on the ground of non using the Assets
due to accident, disorder or may other reason whatsoever.

7. That, it is hereby specifically agreed between the parties here to that where the loan is payable in
installments, failure on the part of the Client to pay any installment to the Bank on its due date
shall entitle the Bank to demand immediate payment of the entire balance of the loan with accrued
interest and other charges remaining due and for recovery thereof to take possession of the goods and to
sale the same notwithstanding anything to the contrary contain in the agreement.

8. That, if the Client fails to pay three consecutive installments the Bank shall have the right to take over
the procession of the assets and then the amount of the loan remaining outstanding

9. Even after deposit of the proceeds of deposited Assets, shall be paid by the Client on demand of the
Bank.

10. That the Bank has made / shall make delivery and the Client has taken/shall take possession of the
Assets on proper receipt.

11. That the ownership of the Assets shall remain in the name of the Bank until the Client makes full
payment of the Assets.

12. That after procurement of the assets by the Bank if the Client fails to take delivery of the same he/she
shall be liable to reimburse the Bank, all the costs and charges incidental to procurement of the assets
and also make good the Bank and loss incurred due to disposal of the assets otherwise.
13. That the Client hereby further convenience as follow:
A) Not to avail of my credit facility under this scheme from any other Branch of the Bank will full-
adjustment of this liability without prior written permission of the Bank.
B) Upon demand made by the Bank at any time or from time to time to execute or cause to be executed all
such instruments, deeds or documents which the Bank may in its sole discretion requite.
C) Bear the cost, of registration, license, Insurance etc. required for the assets where necessary.
D) In case of car, Station, wagon, Microbus, Motorbike etc. bear the cost of Registration, Insurance, Tax
Token and Fitness Fees etc. required for the Assets where necessary:
E) Bear all repairing, overhauling, running and maintaining costs of the Assets and ____________ to pay
all fines, penalties as may be imposed by any competent authority due to violation of any law, rule,
regulation in use of the Assets and the bank shall be covered /compensated by the client from all risks
and losses.
F) Keep informed the Bank, about of any change in Client’s official and residential address.
G) The client as this day executed pro-note and other necessary documents and to hereby acknowledge the
right of the bank to cancel the facility at any time with or without intimation to the client.
15. That, the assets (without insurance coverage) are damaged, lost, etc. due to reasons beyond the control of
the Client and acceptable to the Bank after inspection by the Bank shall be covered/compensated by the
Bank from the risk fund.

16. That, this agreement is made for 60 months and shall remain valid upto
________________________________.

17. That, all or any terms and conditions of this agreement may be amended or modify with mutual consent
of the Bank and the Client.

18. That, the terms between the Bank and the Client wherever the context so permits shall mean and include
Client’s respective successors- in- interest and assigns.

19. That in case of any dispute regarding terms and conditions the decision of the Bank shall be treated as
final binding upon the Client.

20. The Client requests the Bank to disburse the amount of the loan by crediting the same to 06134000983.
