Question 1

The Labor Management Relations Act (LMRA) refers to the act that regulates the activities and

also outlines the rights of unions, employers and employees and it at the same time prohibits

certain unfair labor practices.

The primary purpose of this act is to provide a balance of bargaining power between employers

and employees by allowing employees to organize and bargain collectively and also to impose

certain restrictions on how far unions can go in organizing a company’s employees.

However under LMRA, non-union employees have the following rights;

 It educates the non-union members like Billie Green to join the union.

 It also states to employers that they cannot discharge or discipline employees for filing

charges under the LMRA or for testifying in the proceedings conducted under the act.

Question 2

Duty of fair representation refers to the legal duty of a union to equally, and in good faith,

represent every employee in a bargaining unit, regardless of whether the employee is a union

member or not.

Question 3

The union has met its obligation of fair representation when human resource manager Joe

Rogalski called Green and Swallows for separate meetings to talk of this incident. If after

investigation the charges are found trues against the two employees for committing unfair labor

practices, the NLR Board has the right to orders ceasing of such activity, and also to ask them to
take remedial actions to fix the situation. So it will meet its obligation if the union employment

relationship regarding grievances is well regulated by the union.

Question 4

No, the union in this case has not met its fair representation because according to this act, if the

union employee has a problem at the workplace, he or she should consult the union

representative, and the union has the mandate to decide whether the employee has a reasonable

complaint. If the complaint is genuine the union will file a grievance on the employee’s behalf.

From the case, we find that Green went to the plant to inquire about her grievance unfortunately

was informed that no grievance had been filed on her behalf.
