SUBJECT : RESOLUTION RECOMMENDING TO THE UNIVERSITY PRESIDENT THAT THE

PROCUREMENT OF 980 (1) PCS PERSONALIZED MEDALS 2.5 X 3.32 DIA. AND 980 PCS
DIPLOMA HOLDER A4 CARDBOARD THICK LEATHER COVER FOR SCHOOLS AND
GRADUATE STUDIES GRADUATION USE PER PURCHASE REQUEST NUMBER 2010282
DATED NOVEMBER 9, 2020 BE AWARDED TO MARF TRADING

WHEREAS, Section 10 of Article IV (Competitive Bidding) of R. A. 9184 provides, “All Procurement shall be
done through Competitive Bidding, except as provided for in Article XVI of this Act.”

WHEREAS, Section 48 of Article XVI (Alternative Methods of Procurement) of R. A. 9184 provides,

“Subject to prior approval of the Head of the Procuring Entity or his duly authorized representative, and whenever
justified by the conditions provided in this Act, the Procuring Entity may, in order to promote economy and
efficiency, resort to any of the following alternative methods of Procurement:

d) Shopping- a method of Procurement whereby xxxxxx;

e) Negotiated Procurement- a method of Procurement that may be resorted under the extraordinary
circumstances provided for in Section 53 of this Act and other instances that shall be specified in the IRR, whereby
the Procuring Entity directly negotiates a contract with a technically, legally and financially capable supplier,
contractor or consultant.”

WHEREAS, Section 53 of RULE XVI, 2016 Implementing Rules and Regulations (IRR) of R.A. 9184
otherwise known as the Government Procurement Reform Act provides, “Negotiated Procurement is a method of
Procurement of Goods, Infrastructure Projects and Consulting Services, whereby the Procuring Entity directly
negotiates a contract with a technically, legally and financially capable supplier, contractor or consultant in any of
the following cases:”

53.8 Defense Cooperation Agreement. Upon prior approval xxxxxx.

53.9 Small Value Procurement. Procurement of Goods, Infrastructure Projects and Consulting Services
where the amount involved does not exceed the threshold prescribed in Annex “H” of this IRR: Provided that in case
of Goods, the procurement does not fall under shopping in Section 52 of this IRR.

WHEREAS, paragraph a) Definition, Annex “H” of 2016 Revised Implementing Rules and Regulations of
R.A. 9184 provides:

“a) Definition x x x

i. For NGAs, GOCCs, GFIs, SUCs, and Autonomous Regional Government, One Million Pesos
(P1, 000,000.00).

WHEREAS, paragraph b) Procedure, Annex “H” of 2016 Revised Implementing Rules and Regulations of
R.A. 9184 provides:

“a) Procedure x x x

“i. The End – User shall x x x

‘ii. The BAC shall prepare and send the RFQs/RFPs to at least three (3) suppliers, contractors or
consultants of known qualifications. This, notwithstanding, those who responded through any of the
required postings shall be allowed to participate. Receipt of at least one (1) quotation is sufficient to
proceed with the evaluation thereof.

WHEREAS, the bonafide suppliers who submitted their price quotations were A & B Enterprises, La Naval
Printing Press and Marf Trading;

WHEREAS Marf Trading submitted their lowest price quotation with a total amount of Two Hundred Eighty-
Nine Thousand One Hundred Pesos (Php. 289,100.00);

NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED to recommend to the University

President that the procurement of 980 pcs. Personalized Medals 2.5 x 3.32 dia. 980 pcs. Diploma Holder A4
Cardboard Thick Leather Cover for schools and graduate studies graduation use per purchase request number
2010282 dated November 9, 2020 be awarded to Marf Trading.
