WITNESS’ AFFIDAVIT

I, ROSE ANN LOCULAN, of legal age, single, Filipino, and a resident of

Km. 14, Panacan, Davao City, Philippines, hereby declare and state that:

1. I am the person whose personal circumstances are described in

the Witness-Affidavit;

2. I know the person of EVANGELINE JIMENEZ (“Eva” for brevity) who is

our neighbor at ___________________________________________;

3. I know the person of LYDIA C. CALLANO (“Lydia” for brevity) for she
was also our former neighbor at Camp Panacan, Davao City and a
friend of my mother LILIA LOCULAN;

4. I and my mother were an occupant of a house of Lydia at Camp

Panacan, Davao City from _______________ until _______________;

5. Sometime on July 2008, I and my mother were having conversation at

a waiting shed near the house were are occupying when Lydia came
to us;

6. While having conversation with us, Lydia told us that they have
confrontation with Eva at the Barangay. She also told us that:
“Naningil na naman sya sa akin, kakabayad ko lang sa kanya”. If
translated in English would mean: “She again asked payment of my
debt, I just recently paid her”. Moreover, Lydia uttered the words:
“Inubus nya na naman ang pera nya sa lalaki nya”. If translated in
English would mean: “She squandered her money to her lover”;

7. I attest to the truthfulness of the foregoing facts for whatever legal

purpose this may serve.
