Carlos City, Pangasinan under CC NO. SCC-3707 for Robbery
in Band dated March 25, 2010 for Service of Sentence; and
f. COPLAN RUFFIAN dated August 5, 2011.

2. The above references, pertain to the service of Alias/Warrant of


Arrests implemented by the Joint personnel of this Office and Intel Br ACPO led
by undersigned on September 3, 2011 at about 1:25 pm that resulted in the
arrest of EDUARDO NALUZ y Plamberhim @ Teng, Leader of Naluz Group as
catered in “COPLAN RUFFIAN” at Brgy Bintog, Plaridel, Bulacan while driving
Mitsubishi-Fuso CANTER FV color yellow bearing plate number EBL 826. The
subject person is a leader of the said Organized Crime Group engaged in akyat
bahay, Katok-Katok (K2K) house, Carnapping and Robbery Hold up operating in
the vicinity of Angeles City, Pampanga Province and Metro Manila Areas.

3. Please be informed that on September 6, 2010, subject arrested


person was brought to the Regional Trial Court, First Judicial Region, Branch 57,
San Carlos City, Pangasinan for disposition and subsequently, turned-over to the
Bureau of Jail Management and Penology of said City pursuant to
Commitment Order issued by HON. RENATO D. PINLAC, Presiding Judge of
said court on the same date, to serve his sentenced to suffer imprisonment. The
turned-over of the living body of NALUZ was duly received by JO2 Salazar, EB
at about 3:00pm of the same date. (See attached Commitment order)

4. Currently, continuous hunt down is being undertaken by this Office


for the immediate arrest and locate the possible lair of Naluz Group remnants
and bring them into justice.

September 15- 23, 2010. Fields Avenue, Balibago, Angeles City and PNP
Training Service, Clark Special Economic Zone, Clarkfield, Pampanga

4. NARRATIVE OF OPERATION:

a. Background:

This is a Joint Entrapment Operations of several establishments namely:


Café Camelot, Dirty Duck, and Forbidden City all located at Field Avenue,
Balibago, Angeles City for an alleged trafficking of minor girls used for
prostitution and other sexual exploitation and for the conduct of a search and
rescue operation of alleged trafficked victims found in said establishments in
violation of Rep. Act. 9208 otherwise known as “ Anti-Trafficking In Persons Act
of 2003” in Relation to RA No 7610 also known as “Special Protection of
Children Against Child Abuse, Exploitation And Discrimination Act” conducted by
composite team of Criminal Investigation and Detection Group, Pampanga CIDT
led by PCI DANILO G MENDOZA under the direct supervision of PSSUPT
RUDY G LACADIN, Regional Chief, 3RCIDU; NBI – Central Luzon Regional
Office led by Atty. Ricardo Diaz, SILG led by PCI Orlando Castel; CIDG Legal
Service led by Atty. Emily Trinidad, SAF led by PINSP Duque and DSWD.

Information received by NBI-CELRO disclosed that minors are employed


as GROs / dancers for prostitution at the said establishments. Female employees
known as “Mama Sang” who also work as waitresses make transaction with a
prospective customer offering minor victim to engage in sexual services or
lascivious acts for monetary consideration commonly termed as “bar fine” which
will then be remitted to the cashier.

The foregoing information was confirmed by assets to be true requiring


the need of launching an immediate action, hence final coordinating conference
among the operating units was called upon by Atty. Ricardo Diaz and was held at
the PNP Training Service Office, Clark Field, Mabalacat, Pampanga. The
purpose of which was 1.) To create Three (3) teams and properly brief them
about the nature of operation; 2). To identify the target establishment assigned
for each team ;and 3). To specifically designate tasking to each of the team.

b. On or about 10:00 in the evening of September 25, 2010,


Pampanga CIDT prepared a Pre Coordination Sheet and sent to Pampanga
Police Provincial Office and Angeles City Police Office thru fax for their
information.

c. For the Café Camelot operation, it was Special Investigator


Ernesto M. Bondoc and NBI Asset and PO2 Kherwin Evangelista who posed
as customers while CIDT and PNP SAF acted as back-up. During the operation,
the NBI asset gained the trust of a “Mama Sang” and offered a minor, Vanessa
Adobas y Mendoza to perform oral sex with the NBI asset in exchange for
Php1,500.00 as monetary consideration. After the marked money was handed
down to the mama sang by the NBI asset, the prearranged signal was made to
the team leader to notify the latter that the transaction was consummated.

d. With the Dirty Duck operation, it was Agent Dennis Montaya


and PO3 Sidney Gabieta who posed as poseur customers while the rest of the
raiding team positioned themselves strategically waiting for the pre-arranged
signal to strike. The same modus operandi was done by a mama sang in said
establishment. The “mama sang” offered a GRO to PO3 Gabieta for sexual
intercourse for Php 1, 500.00. When the marked money handed down to the
mama sang. Agent Montaya immediately made to signal to the back up team for
the simultaneous arrest of respondents and rescue of minors.

e. More than two hundred women includingnineteen (19) minor


girls were rescued from the ESTABLISHMENTS as a result of the simultaneous
raids conducted by the composite entrapment team.

f. Respondents were arrested, booked and detained at the


PNP Training Service facility at CLarkfield, Pampanga. Appropriate charges for
Violation of RA 9208 (Anti Trafficking Persons Act of 2003) was thereafter
prepared. Hence, the instant inquest referral.
g. During inquest proceedings, Respondents were notified of
their rights under the constitution and were advised to seek the assistance of a
counsel of their choice. After which, the inquest proceeded.

h. Arresting officers, in the person of Atty. Magno R. Britanico,


PSI Reynold Villana, PO1 Froilan P. Gebe jr, Agent Dennis Montoya, PO3
Sidney Gabieta, Special Investigator Ernesto M Bondoc and PO2 Kherwin
Evangelista all affirmed before the undersigned, that surveillance and
investigation conducted by their team confirmed the activities of the said
establishment.

i. Minor, Mary Ann Nadera, in her Sinumpaang Salasaysay


dated September 16, 2010, and as affirmed before the undersigned, that she
was born April 4, 1994 and that she hails from Cebu City. On August 2010, she
was hired as a dancer by Mama Sang Anita Montarola in Café Camelot. Part of
her job includes dancing, wearing only a bra and bikini, in front of customers and
having sexual intercourse with a customer who pays the bar fine. She knows that
the name of the owner is certain Daddy Tony.

j. Aside from her, two other minors in the person of Vanessa


Adobas y Mendoza and Renalyn Pinto were rescued at Café Camelot and were
turned-over to the DSWD.

k. Noelyn Sanchez Allego, also a minor, in hwer Sinumpaang


Salaysay dated September 16, 2010, and affirmed before the undersigned, that
she was born on October 21, 1993 and hails from Mexico, Pampanga. On
August 2010, she was hired by a certain Mommy Ana, as a dance in Club
Forbidden City. Part of her job includes and to accompany a customer to a hotel
for sexual services known as a bar fine. She only receives Php 250.00 per night
for dancing.

l. Kimberly Ramos Nuqui, on her part, stated that she is 17


years of age, having been born on May 30, 1993. She was hired as a dancer in
Forbidden City last September 2010 by a certain Mommy Kim, her job
entertaining male customers while the latter drinks and she receives Php 160.00
per night.

m. Minor Emely Dayrit Batac, on her part, stated that she is 17


years old born on December 5, 1993. She was hired by a certain Mommy Kim in
Club Forbidden City as a dancer since September 2010. Her job includes
dancing with bra and shorts in front of customers, entertaining male customers
while the latter kissed and hugged her.

n. These allegations were corroborated by Karl Ryll, a


confidential agent of the NBI, who went to Forbidden City on the said operation.

o. Another minor, Maricris Tabay Batiao, also affirmed before


the undersigned that she is 15 years old. She was bord on October 14, 2010 and
hails from the province of Davao. On September 14, 2010, she was hired by a
certain Mama Sang named Bamba as a dancer in club Dirty Duck. Being a
dancer she is required to wear bra, shorts and a tube while dancing in front of
male customers mostly foreigners.

p. Minor Jennifer Magat y Layson who was also rescued,


confirmed the exploitation in Dirty Duck and even stated that she would entertain
male customers while the latter kiss her in lips and caresses her all the while.
q. During said inquest proceedings, one of the respondents,
Jade Lacson, a bartender of Dirty Duck, manifested that they are just employees
of the club. They are not engaged in any illegal activities, and told the
undersigned that the real owner of the club is a certain Lewis Yakich. Ms. Jade
Lacson even showed to the undersigned the petty cash vouchers dated
September 2 and 4 , 2010, where a certain “Lewis” received a Php 228,000.00
and Php 50,000.00 as dividends from Club Dirty Duck.

Hence, we rule

After a judicious evaluation of the evidence at hand, we find probable


cause against respondents Lewis Yakich, Belinda C orbeso, Noralyn Q Basco
and Ma. Beverly M Samson of Dirty Duck, James Hutchinson y Stoker, Lea
Rosalie Smaonte, Anita Montarola y Montejo, Erlinda David Fajardo, Baby
Guangko y Mallari and Alma Dawisan of Café Camelot and NArciso Roque,
Gibeth Garbo, Rio B Bulosan and Angel Galanf of Forbidden City.
Credence can be given weight to the statements of the arresting officers
who personally witnessed the exploitation of women in said establishments that
demeans and debased their human dignity. Said arresting officers narrated how
the mama sang, cashier, book keepers as well as the floor managers and owners
of the club connived with one another for the purpose of exploiting the women for
their benefit.
More sothat minors, Mary Ann NAdera, Noelyn Sanchez Allego, Kimberly
Ramos Nuqui, Emely Dayrit Batac, Maricris Tabay Batiao and Jennifer Magat y
Layson have affirmed the despicable acts of respondents of exploiting exhibition
of their bodies in front of foreign customers and sexual congress for a fee with
willing customers, a sheme that is called bar fine.
Sec. 4 of RA 9208 or Anti Trafficking Persons Act of 2003, makes it
unlawful for any reason, natural or juridical to recruit, transport, transfer, harbor,
provide, or receive a person by any means inlcluding those done under pretext of
domestic or overseas employment or training or apprenticeship, for the purpose
of prostition, pornography, sexual exploitation, labor, slavery, involuntary
servitude or dept bondage.
Prostitution is deined under sec 3 (c) of RA 9208 as referring to an act,
transaction, scheme or design involving the use of a person by another, for
sexual intercourse or lascivious conduct in exchange for money, profit or any
other consideration.
It was duly shown by the PNP-NBI team with the assistance of the DSWD
team that said women are indeed minors through their dental health records;
hence, a minor at the time of the commission of the offense, making the crime
qualified trafficking as well as violation of RA 7610.

1. References: Complaint of RAMON CATIVO y Basangan of Camila St.,


Purok Gloria II, Sindalan, City of San Fernando.

2. This is relation to the Spot Report submitted on October 1, 2010


pertaining to the Entrapment Operations conducted on the same date at the Shell
Station, Mc Arthur Highway, Brgy. Sto. Cristo, Angeles City led by the undersigned
with the direct supervision of the Regional Chief, 3RCIDU, that resulted to the arrest of
HENRY JORGE VICTORIANO y Magcaling after receiving the dusted money
amounting to Two (2 Hundred Pesos from the complainant, RAMON CATIVO.
Simultaneously, follow-up operation was conducted at the Angeles City Cockpit Arena,
Angeles City resulting to the arrest of One (1) PINSP ARNOLD SANTOS who later
identified as RICARDO AGUILOS y SANTOS who previously forcibly took the
cellular phone and Driver’s License of the complainant.

3. After their arrest, both suspects were brought to this office for booking
and
documentation, thereafter, Mr. Henry Jorge Victoriano was brought to the PNP Crtime
Laboratory Office, Camp Tomas Pepito, Sto. Domingo, Angeles City for forensic
examination which turned to be positive for the presence of Ultra Violet Powder.

4. Suspect RICARDO AGUILOS y SANTOS was charged for Robbery With


Violence or Intimidation of Persons while HENRY JORGE VICTORIANO y Magcaling
was charged for Usurpation of Authority.

5. Upon the completion of the investigation, the duo were inquested before
Pros. Allan Pasamonte who gave the following recommendations quoted as follows: “To
determine the sufficiency of pieces of evidence submitted, further preliminary
investigation is required. The respondents are recommended to be RELEASED
from detention in the meantime for the conduct of said investigation set on 06
October 2010 at 2:00 PM”. The same was approved by the City Prosecutor, hence
respondents were released to their counsel Atty. Mark Lomboy after duly recorded in the
Police Blotter.

SIR/MADAM:

Greetings!

In line with the State policy embodied in Art II, Section 15 of the l987 Constitution
that: “The State shall protect and promote the right to health of the people and
instill health consciousness among them”.

In accordance with the above policy and in our fervent desire to eradicate the
illegal proliferation of regulated drugs in our immediate area of concern, the
undersigned most respectfully submit to your good office the following items,
requesting for Laboratory Examination:

a. 2 small boxes of VIAGRA 100mg containing 4 film-coated tablets in


each box with “Pfizer” markings marked as PCIDT “A and A-1”;
b. 2 small boxes of Black Ant, 4600mg containing 3 tablets in each box
labeled with Chinese character, marked as PCIDT “B and B-1”;
c. 2 small boxes of Cialis 20 mg containing 4 film-coated tablets in each
box marked as PCIDT “C & C-1; &
d. One small box of TADAFIL containing sealed small white plastic
container of unidentified number of tablets marked as PCIDT “D”
respectively.

The purpose of the examination is to determine whether subject drugs are


among the illegally manufactured, imported and misbranded drugs posing gross
deception to the consumer and imminent danger to the health of anybody that
would use them. Likewise, to determine whether they are fitted for human
consumption.

Further, request to furnish this office written result of the conducted laboratory
examination for our ready reference.
