QUESTION

Zaid is interested to buy a double storey house belong to Amin. The property
is held under the title no. H.S. D 235, Lot 167, Mukim Serendah, District of
Kepayang, Selangor. The property is currently charge to Bank DCB. The
property is subject to a restriction in interest that states the said land cannot
be transferred or charged or leased without the consent from the state
authority. They wish to formalize the oral agreement. Amin who is your client
comes to see you with Zaid who never bought any property before.

a. Explain the importance of conducting the land search and bankruptcy


search on the parties at the initial stage of the sale and purchase
transaction.

b. Based on the above facts, identify the necessary documents that need
to be procured by the Vendor and its significance to the conveyancing
process.

c. Both parties want you to act for them. Advise parties on the legal
position with respect to the Legal Profession Act and Bar Council’s
Conveyancing Practice Rulings on this issue.

d. If you act for the purchaser, explain to the Vendor what you can do for
him if he chose not to be legally represented.
