MANIFESTATION AND MOTION

COMPLAINANT, by counsel, unto this Honorable Office, most

humbly and respectfully manifests and moves:
1. On 24 August, 2020, undersigned counsel received a copy of the
Decision in the above-entitled cases by the Honorable First Division of
the National Labor Relations Commission (NLRC). Said Decision did not
give due course to the appeal filed by the respondents Paravisible
Builders, Inc. and Rodel Pabalate and their motion to reduce the appeal
bond became moot and academic.

2. On 24 September 2020, undersigned received a copy of the

respondent’s counsel (Atty. Rodolfo R. Ranion) Notice of Withdrawal
dated 19 August 2020, and thereafter, on 05 October 2020, received an
“Entry of Appearance” and “Motion to Set Case for Conference for
Possible Settlement” by Atty. Rosario Dolores V. Dulay.
 3. Let it be underscored that, to date, undersigned has not
received any copy of respondent’s “Motion For Reconsideration” to the
Honorable First Division NLRC Decision.

4. Hence, the Honorable Executive Labor Arbiter’s Decision dated

October 30, 2019 in the above-stated cases were already final and
executory as of September 9, 2020.

PRAYER

WHEREFORE, premises considered, it is most humbly and

respectfully prayed of this most Honorable Office that an “Entry of
Judgment” be issued in the above-entitled cases.

Other reliefs and remedies which are just and equitable in the
premises are likewise prayed for.

OTHER RELIEFS, just and equitable under the premises are

likewise being prayed for.
