Republic ofthe Philippines PROVINCE OF QUIRINO Cabarroguis -000- OFFICE OF THE PROVINCIAL GOVERNOR EXECUTIVE ORDER NO., Series of 2020 AN EXECUTIVE ORDER CREATING THE PROVINCIAL APPRAISAL COMMITTEE DEFINING ITS FUNCTION IN THE ACQUISITION OF THE PRIVATE PROPERTY BY THE PROVINCIAL GOVERNMENT OF QUIRINO AND OTHER CONCERNED AGENCIES: Whereas, Section 201 of the Local Government Code 1991 and Article 291 of its implementing Rules and Regulations (IRR) provide that the Department of Finance shall promulgate the necessary rules and regulations for the classification, appraisal and assessment of the property; Whereas, the Department of Finance issued the Manual on Real Property Appraisal and Assessment of Operations to provide local assessment and treasury officials with guidelines that will enhance their knowledge and skills with the adoption of a uniform system of real property appraisal and assessment for taxation purpose thru Local Assessment Regulations No. 1-04 in October 01 2004; Whereas, the Manual on Real Property Appraisal and Assessment Operations dated January 2006, under Chapter Vill, Miscellaneous Provisions of the Manual, Section |, provides that “Whenever a private property is subject to acquisition by the government for public use that property is referred to the Provincial Appraisal Committee for it to determine the market value”; Whereas, there is a need to provide mechanism to facilitate acquisition of private property for public use through Negotiated Sale or Expropriation Proceedings: WHEREFORE, in the light of the foregoing and in pursuance of the General Welfare provision of the Constitution and the Local Government Code, |, DAKILA CARLO E. CUA by virtue of the power vested in my office, HEREBY ORDER, The: SECTION 1. CREATION OF THE PROVINCIAL APPRAISAL COMMITTEE. There is hereby created a Provincial Appraisal Committee to be composed by the following personnel, to wit: Chairman: MR. AVELINO A SILAO, JR., Tax Mapper IV, OPAS Members: ENGR. ROBERT SALVADOR, Engineer IV, PEO CLARABEL A. CATU, Acting Provincial Treasurer, PTO SECTION 2. FUNCTIONS. The Committee shall have the primary function to determine the market value of a private property subject for the acquisition for the public use. In the exercise of its function, it shall ensure that the Philippine Valuation Standard, other laws, rules, regulations and issuances applicable on the matter shall be strictly adhereD to. The following specific functions of the committee are; 1. To conduct field inspections, evaluate and appraise real properties subject for acquisition by the government; 2. To submit Appraisal Report to the requesting parties or agencies including its recommendations and justifications that the appraised value of the subject property is fair, just and reasonable; 3. To perform all clerical, secretarial and administrative work related to the functions of the Committee. SECTION 3. COVERAGE. The following shall be considered among others as public use, purpose or welfare; 1. Construction or extension of roads, streets, sidewalks, viaducts, bridges, ferries, levees, wharves or piers; 2. Socialized housing; 3. Construction or Improvement of public buildings maintained and operated by the government for public use such as nurseries, health centers, or hospitals, buildings for research, breeding, or dispersal centers for animals; 4, Construction of artesian wells or water system; 5. Establishment of parks, playgrounds, plaza’s public market, drainage systems, cemeteries or crematories; 6. Construction of irrigation, canals or dams; and 7. Other infrastructures for public use or purpose. SECTION 4. FUNDING/ OPERATING COSTS. All costs pertaining to its operation, including the payment of honoraria, incentives and other expenses of the committee and other appropriate personnel doing the job shall be taken from the available funds of the requesting offices or agencies subject to the usual accounting and auditing rules and regulations. SECTION 5. SEPERABILITY CLAUSE. If any provisions of this Executive Order is declared invalid or unconstitutional, the other provisions not affected thereby shall remain valid and subsisting. SECTION 6. Effectivity Clause. This Executive order shall take effect immediately. DONE IN THE PROVINCE OF QUIRINO, this _ day of in the year of the Lord, ‘Two Thousand and Twenty. DAKILA CARLO E.
