Abstract
The penal mediation system was established as a new mechanism in line with the criminal
scientific development that seeks to reform justice and as a means of guaranteeing rights and
freedoms. The amendment of the Algerian Code of Criminal Procedure is based on Order 15.12
of 23 July 2015 to support the reform of justice program And to give it a dimension of social
consensus based on the idea of reforming the offender, as well as the damage caused by the
crime as an alternative to the idea of applying punishment, ie avoiding the suspect to the risk of
criminal prosecution.
