Case: A woman who has been working for a company employing 150
employees for the last 4 years, gives birth to twins. She has duly notified the
company of her pregnancy.
Ans: Yes, the women will be entitled to all the maternity benefits provided
under the principal act (The Maternity Benefits Act, 1961) and The
Maternity Benefits (Amendement) Act, 2017.
b) If she were to have another child 2 years later, would she be entitled
to maternity benefit for the birth of the youngest child?
Ans: Yes, as per the principal act (The Maternity Benefits Act, 1961) and
The Maternity Benefits (Amendement) Act, 2017, this women will be eligible
for maternity benefit for her third child. But, she will be entitled to a maximum
period of twelve weeks only of which not more than six weeks shall precede the
date of her expected delivery since she already has two surviving children.
