BUHANGIN ON 10 APRIL 15, 2020 AND TO REMAIN IN EFFECT UNTIL THE DECLARED 11 ENHANCED COMMUNITY QUARANTINE IS LIFTED NY THE CITY 12 GOVERNMENT IN CONNECTION WITH THE PREVENTION AND/OR 13 MITIGATION OF THE LOCAL TRANSMISSION OF COVID-19 IN THE 14 CITY OF BUTUAN, PROVIDING PENALTIES THEREFORE AND FOR 15 OTHER PURPOSES 16 17 Be it ordained by the Honorable Sangguniang Panlungsod of Butuan City in session 18assembled and by authority of the same that: 19 20 SECTION 1. DECLARATION OF POLICY. (a) It is hereby declared the policy of 21the City that the health, safety and the general welfare of the people of Butuan is always of 22paramount import. Towards this end, the City shall enact measures in order to prevent and/or 23mitigate the local transmission of infectious diseases in the City such as Covid-19 through the 24temporary closure of certain and identified roads in Brgy. Baan Riverside, Brgy. Mahogany, and 25Brgy. Buhangin in order to properly and responsibly manage the movement of persons and 26vehicles, in and out of the aforementioned localities. 27 28 (b) It is also the policy of the City to capacitate the different barangays within its 29territorial jurisdiction to institute measures to prevent loss of life, utilize appropriate resources 30and implement urgent and critical initiatives to contain or prevent the spread of infectious 31diseases such as Covid-19, in order to mitigate its effects and impact to their respective 32communities, and prevent serious disruption of the functioning of the government and the 33citizenry of Butuan City. 34 35 SECTION 2. TEMPORARY ROAD CLOSURE. The following roads shall hereby be 36temporarily closed round-the-clock until the declared Enhanced Community Quarantine is lifted 37by the City Government: 38 39 a. Barangay road of Brgy. Baan Riverside passing through Purok 3, 5A, 6, 6A, 6B 40 and 7- up to the north boundary road of Brgy. Mahogany. 41 b. Barangay road of Brgy. Baan Riverside passing through Purok 5B, 5, 4, 2B, 2, 2, 42 2B,- up to the south boundary road of Brgy. Buhangin. 43 44 SECTION 3. IMPLEMENTATION. The Barangay Council shall be primarily 45responsible for the effective implementation of the closure of roads within their respective 46territorial jurisdiction. The concerned Barangay Council shall coordinate with the Land 47Transportation Traffic Management Office (LTTMO) to ensure the organized, efficient and 48systematic enforcement of road closure. The Barangay Council concerned shall see to it that 49adequate and appropriate signs and devices are installed. The enforcers assigned at the areas of 50road closure shall facilitate the imposition of alternative routes of vehicular traffic flow for the 51convenience and safety of the public. 52 53 Whenever it is deemed necessary in consideration of public safety and security, the 54LTTMO may take over and supervise the temporary closure of road to ensure effective 55implementation of the ordinance. 56

Temporary Road Closure, 1st Mindanao Grand Feast, Light of Jesus – Butuan March 12, 2020, 3 PM to 10 PM 57 At the end of the duration of authorized temporary closure of roads, the Barangay 58Council concerned shall immediately open the closed roads to the public for use and inspect their 59condition to determine if there are any damages or destruction. 60 61 62 SECTION 4. GENERAL TRAFFIC MANAGEMENT POLICY. The City Mayor, 63through the LTTMO, may, in emergency cases, undertake precautionary measures relative to the 64traffic management of the City, which include the redirection of traffic, the opening or transfer of 65road barriers, the installation or removal of traffic signs, and such other measures for the 66promotion of public health and safety. 67 68 SECTION 5. RESPONSIBILITY OF THE BARANGAY COUNCIL. Any untoward 69incident, damage or destruction which may occur during the temporary closure of road shall be 70the sole responsibility of the Barangay officers if it is shown that they have acted beyond and/or 71has abused their authority or shall have failed to exercise prudence and diligence required of 72them under the law. 73 74 SECTION 6. EXCEPTIONS. The following shall be the exceptions to the temporary 75road closure: 76 77 a. Motor vehicle of frontline workers such as doctors, nurses, midwife, police officers and 78 nursing assistants while going to and from work; 79 b. Motor vehicle carrying a physician or health worker who is responding to an emergency 80 call; 81 c. Hospital ambulance or emergency vehicle on the way to and from the place of a road 82 crash or other emergencies; 83 d. Vehicle carrying a wounded, injured, or sick person for emergency treatment to a 84 hospital, clinic or any other similar places; 85 e. Motor vehicle belonging to the Armed Forces, while in use for official purposes; 86 f. Motor vehicle belonging to Philippine National Police, while in use for official purposes; 87 g. Motor vehicle of the fire department, while responding to an emergency; and 88 h. For security reasons, very important persons (VIP) such as visiting National Government 89 Officials and other dignitaries. 90 91 SECTION 7. PENAL CLAUSE. Any vehicle driver who violates Section 2 of this 92Ordinance shall pay the penalty of One Thousand Five Hundred Pesos (PhP 1,500.00) without 93prejudice to the filing of appropriate cases in court by the City Government. 94 95 SECTION 8. APPLICABILITY. This ordinance shall be effective only within the 96duration of the declared enhanced community quarantine by the City Government. The authority 97for the temporary closure of roads shall be rendered automatically as withdrawn, cancelled and 98annulled upon the lifting, cancellation or withdrawal of the enhanced community quarantine by 99the City Government. 100 101 SECTION 8. EFFECTIVITY CLAUSE. This Ordinance shall take effect immediately 102upon approval. 103 104 SECTION 8. INFORMATION DISSEMINATION CLAUSE. Let copies be 105furnished the Offices of the City Mayor, the City Administrator, and the City Disaster Risk 106Reduction and Management Officer, the City Public Information Office, the Land Transportation 107Traffic Management Office (LTTMO), the Butuan City Police Office, the Sangguniang 108Barangay of Baan Riverside, the Sangguniang Barangay of Brgy. Mahogany and the 109Sangguniang Barangay of Buhangin for information, guidance, and appropriate action. 110 111 The City Public Information Office is hereby directed to facilitate the dissemination of 112this Ordinance for public guidance.
