LEASE CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and executed at the City of Antipolo, Province of
Rizal, this day of 1st of Aug 2020, by and between:

MICA ANGELA RAMOS, MICHAEL RAMOS and LIZA TOLENTINO with registered
address at B3 L13 BLOOMFIELD STREET ANTIPOLO GREENDLAND SUBD.,
SUMULONG HIGWAY ANTIPOLO CITY herein after referred to as the “LESSOR”.

-AND

FROILAN NAGERA PUNO, represented by of legal age, with a registered address at BLOCK
2 LOT 3, ST. THERESE STREET, OUR LADY OF FATIMA VILLAGE, BRGY. SAN ISIDRO
ANTIPOLO CITY herein after referred to as the “LESSEE”.

WITNESSETH; That

WHEREAS, the LESSOR is the owner of THE LEASED PREMISES, a residential property
situated at unfurnished Unit 3750A Tower 5 at Fern at Grass Residences, Bago Bantay,
Quezon City.

WHEREAS, the LESSOR agrees to lease-out the property to the LESSEE and the LESSEE
iswilling to lease the same;

NOW THEREFORE, for and in consideration of the foregoing premises, the LESSOR
leasesunto the LESSEE and the LESSEE hereby accepts from the LESSOR the LEASED
premises,

subject to the following:

TERMS AND CONDITIONS

1. PURPOSES: That premises hereby leased shall be used exclusively by the LESSEE for
residential purposes only and shall not be diverted to other uses. It is herebyexpressly agreed that
if at any time the premises are used for other purposes, theLESSOR shall have the right to rescind
this contract without prejudice to its other rights under the law.

2. TERM: This term of lease is for six (12) MONTHS from Aug 1, 2020 to Jul 31, 20201.
Upon its expiration, this lease may be renewed under such terms and conditions as may be
mutually agreed upon by both parties, written notice of intention to renew the lease shall be
served to the LESSOR not later than thirty (30) days prior to the expiry date of the period herein
agreed upon.

3. RENTAL RATE: The monthly rental rate for the leased premises shall be in PESOS
Seventeen thousand PESOS (Php 24,966.00), Philippine Currency and Exclusive of
Association Dues. All rental payments shall be payable to the LESSOR.

4. ADVANCE RENT: Upon execution hereof, the LESSEE agrees to pay LESSOR the total
amount of One Hundred Thousand PESOS (Php 100,000), Philippine Currency,
representing Security Deposit. Monthly payments afterwards shall be made to the LESSOR
thru cash payment or online banking cash transfer.

5 SECURITY DEPOSIT: That the LESSEE shall pay to the LESSOR upon signing of this
contract and prior to move-in an amount equivalent to the sum of One Hundred Thousand
Pesos (Php 100,000.00), Philippine Currency.

Wherein the Security deposit shall answer partially for damages and any other obligations, for
utilities such as Water, Electricity, CATV, Telephone, or resulting from violation(s) of any of the
provision of this contract.

The Security Deposit shall serve as security for the faithful performance by the LESSEE of its
obligation under this Contract of Lease and to answer for any unpaid utilities and charges, and to
cover for whatever damages on the Leased Premises.

The Security Deposit or the balance thereof after application of unpaid utilities/charges and
damages, if any, shall be refunded to LESSEE without any interest fifteen (15) days after
termination of this Contract of Lease. However, should all utilities/charges be settled within thirty
(30) days from the expiration of lease and no damages has been reported, the LESSOR shall
refund the security deposit earlier than five (5) days.

In case of renewal or extension of the Lease Term, the Security Deposit shall be adjusted to
correspond to the new lease rental and which adjustment shall be made payable to the LESSOR
by the LESSEE within ten (10) days from date of renewal or extension.

6. DEFAULT PAYMENT: In case of default by the LESSEE in the payment of the rent, such as
when the checks are dishonoured, the LESSOR at its option may terminate this contract and eject
the LESSEE. The LESSOR has the right to padlock the premises when the LESSEE is in default
of payment for Two (2) month and may forfeit rental deposit or advances which have been given
by the LESSEE.

7. GUARANTEED LEASE – This Contract of Lease is guaranteed for twelve (12) Months. In
the event that the LESSEE desires to terminate this Contract of Lease within the twelve (12)
Months period, the LESSOR reserves the right to forfeit the security deposit and any unused rent.

8. SUB-LEASE / SALE / TRANSFER / MORTGAGE: The LESSEE can directly or indirectly


sublet, allow or permit the leased premises to be occupied in part by any person, form or
corporation, neither shall the LESSEE assign its rights hereunder to any other person or entity
and no right of interest thereto or therein shall be conferred on or vested in anyone by the
LESSEE without the LESSOR’S written approval. In the event of sale, transfer, mortgage, or any
other encumbrance of the Leased Premises or any existing sale, transfer, mortgage or
encumbrance of the same, the LESSOR shall warrant that the purchaser, mortgagee or
encumbrance shall respect all the terms and conditions of this Lease Contract; including the
provisions for renewal thereof. Notwithstanding any conveyance of title over the Leased Premises
to a third party, pursuant to or as a consequence of any sale, transfer, mortgage or any
encumbrance, the LESSOR shall however, continue to be bound by his undertaking in favor of
the LESSEE to return or to reimburse to the LESSEE any advance rentals and/or balance of the
Security Deposit, if any, unless such third party has expressly assumed in writing the LESSOR’S
undertaking and such assumption is accepted by the LESSEE.

9. UTILITIES: The LESSEE shall pay for its telephone, electric, cable TV, water, Internet, and
other public services and utilities during the duration of the lease.

10. MAINTENANCE AND REPAIRS: The LESSEE shall keep the Leased Premises in good,
clean and sanitary condition. The LESSEE hereby acknowledges that it has inspected the Leased
Premises and found the same to be in a good habitable and tenantable condition.

a. In the event that the Leased Premises is delivered to LESSEE furnished or semi-furnished,
LESSEE further hereby acknowledges that the fixtures, appliances and other movable items
indicated in the attached list as Annex “B”,are in good and usable condition, and shall maintain as
such during the duration of this Contract of Lease.

b. The LESSOR shall be responsible for all major repairs on the Leased Premises such as repairs
on the water, electrical and sewage installations caused by ordinary wear and tear, except when
such repairs arise from damage caused by or due to the fault or negligence of the LESSEE,
members of its household, guests, or visitors, in which case, the same shall be for the account of
the LESSEE and shall be considered a violation of this Contract.. The LESSEE shall immediately
report to the LESSOR any major repairs to avoid further damage to the Leased Premises. Minor
repairs on the Leased Premises, on the other hand, shall be for the sole account of the LESSEE.

11. FORCE MAJEURE: If whole or any part of the leased premises shall be destroyed or
damaged by fire, flood, lightning, typhoon, earthquake, storm, riot or any other unforeseen
disabling cause of acts of God, as to render the leased premises during the term substantially unfit
for use and occupation of the LESSEE, then this lease contract may be terminated without
compensation by the LESSOR or by the LESSEE by notice in writing to the other.

12. LESSOR’S RIGHT OF ENTRY: The LESSOR or its authorized agent shall after giving due
notice to the LESSEE shall have the right to enter the premises in the presence of the LESSEE or
its representative at any reasonable hour to examine the same or make repairs therein or for the
operation and maintenance of the building or to exhibit the leased premises to prospective
LESSEE, or for any other lawful purposes which it may deem necessary.

13. EXPIRATION OF LEASE: At the expiration of the term of this lease or cancellation
thereof, as herein provided, the LESSEE will promptly deliver to the LESSOR the leased
premises with all corresponding keys and in as good and tenable condition as the same is now,
ordinary wear and tear expected devoid of all occupants, movable furniture, articles and effects of
any kind.

14. JUDICIAL RELIEF: Should any one of the parties herein be compelled to seek judicial
relief against the other, the losing party shall pay an amount of One Hundred (100) % of the
amount claimed in the complaint as attorney’s fees which shall in no case be less than P50,000.00
pesos in addition to other cost and damages which the said party may be entitled to under the law.

15. This CONTRACT OF LEASE shall be valid and binding between the parties, their

successors-in-interest and assigns.
