ITCO Tank Container e-learning Terms and Conditions

Grant of non-exclusive licence

IMPORTANT
This is a legally binding Agreement between on the one part you and/or any person or entity (' the End User') using this copy of the ITCO Tank
Container e-learning software ('the Software') and on the other part Exis Technologies Limited ('Exis') a Company registered in England. By
accessing the Software you confirm your acceptance of this Agreement.

1. Licence
The End User is permitted to:
1a) Access the Software such that each ITCO Tank Container e-learning course contained in the Software is used by one End User.
The End User is not permitted to:
1b) Print screen displays contained in the Software other than those incorporating a 'Print' command.
1c) Copy, distribute, transfer over a network, loan, lease, sub-licence nor otherwise deal in the Software.
1d) Alter, merge, modify, adapt, reverse engineer nor create derivative works based upon the Software.

2. Warranty and performance of the Software

Exis warrants that the Software will perform substantially as described in advertising materials and user documentation. However, Exis does not warrant
that the Software is free of errors. Exis is not the originator of any regulatory source material contained in the Software and whilst Exis has no reason to
believe that there are inaccuracies or defects in the Software Exis has no liability in respect of the correctness of the information contained therein. In
particular, Exis has no liability for any indirect or consequential loss arising from the End User's use of the Software except that such liability may not
lawfully be excluded. It is the End User's responsibility to ensure that the Software is suitable for the intended purpose and the entire risk as to the
application of the Software is assumed by the End User. No information provided to the End User by any third party shall modify this clause.

3. Remedy
The End User's sole and exclusive remedy is replacement of the Software or refund of the purchase price, at the discretion of Exis, provided that any
claim is made in writing to Exis or the distributor of the Software within ninety (90) days of initial use of the Software by the End User.

4. Updates and amendments to the Software

From time to time updates and amendments to the Software may be implemented by Exis. Exis will provide technical support for this if required.

5. Period of use
The Software may be used for a period of 90 days following the date of first use.

6. Copyright
All copyright, trademarks and other intellectual property rights in the Software are the exclusive property of Exis and/or the International Tank Container
Organisation.

7. Complete agreement
This Agreement shall be the entire contract between the parties in respect of the Software to the exclusion of all previous or present representations,
understandings, agreements or warranties expressed or implied.

8. Your Data and Privacy

We respect your privacy and are committed to storing and protecting your personal data in accordance with current legislation, including the UK Data
Protection Act 1998 and EU General Data Protection Regulation (EU 2016/679). Any data collected by this product is stored by Exis Technologies and
may be processed by both ITCO and Exis Technologies. ITCO and Exis Technologies act as data processors and will only use your personal information
to administer your interest in our products and to continuously improve our services. ITCO's full privacy notice can be viewed at https://international-tank-

9. Law
This Agreement is governed by the laws of England and Wales and the parties agree that any matter arising from it is subject to the exclusive jurisdiction
of the English courts.
