MOTION TO REVIVE CASE

AND TO LIFT WARRANT OF ARREST

Accused, unto this Honorable Court, most respectfully alleges

and moves:

1. On 04 September 2020, the date of arraignment and

pretrial, there was no appearance for the accused. As such, the
public prosecutor sought that a warrant of arrest be issued to the
accused and for the case to be archived.

2. With all due respect to this Honorable Court, the accused

was not in attendance during the 04 September 2020 because he
inadvertently forgot his hearing date and was at work on that day.
The accused’s explanation is attached herein as ANNEX “1” for the
Honorable Court’s reference.

3. In the interim, accused is currently detained at the

________ Lock-up jail.

4. Considering that the accused has already been

apprehended and detained, the accused moves that his herein case
be revived from the archives and that his case be set for hearing at a
date and time most convenient to this Honorable Court.

5. Further, he is seeking the indulgence of the Honorable

Court that he be released from his current detention facility on the
strength of the same bond he has previously posted, premised on his
promise that he will attend future hearings as may be required by the
Court.
 6. That this motion is being filed without prejudice to any
other remedy which may be available to the accused and is not
intended to delay the proceedings of this Honorable Court.

PRAYER

WHEREFORE, it is most respectfully prayed for by the accused

from this Honorable Court that his case be revived from the archives
and for the same to be set for hearing at a date and time most
convenient to this Honorable Court.

It is also prayed for by the accused for his release from the
___________ Lock-up jail on the strength of the same bond he has
previously posted, premised on his promise to attend hearings as
may be scheduled.

Other reliefs just and equitable are likewise prayed for.
