CONTRACT OF SERVICE

COMPUTER PROGRAMMER

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT entered into by and between:

The Schools Division Office of Legazpi City with office address at Purok-1 Rawis,
Legazpi City, Albay herein represented by MR. CRESTITO M. MORCILLA, Schools
Division Superintendent, herein referred to as the “FIRST PARTY”.

-and-

MR. JONATHAN TUMALA, of legal age, Filipino and with residence address
Legazpi City, Albay, herein referred to as the “SECOND PARTY”.

-WITNESSETH-

1. That the First Party is in need of the services of the SECOND PARTY who shall
perform the work not performed by the regular personnel of the FIRST PARTY;

2. That the SECOND PARTY has signified his intention to which the FIRST PARTY
has accepted, to provide the services needed by the latter;

3. That the SECOND PARTY hereby possesses the education, experience and skills
required to perform the job as described herein;

4. That the SECOND PARTY hereby attests that he has not been previously dismissed
from government service or private institutions by reason of an administrative offense;

5. That in view hereof, the SECOND PARTY is hereby contracted as COMPUTER

PROGRAMMER with a salary of TWENTY-FIVE THOUSAND (Php 25,000.00)
PESOS per month;

6. That the COMPUTER PROGRAMMER, the SECOND PARTY, is expected to

perform the following functions:

6.1 Computer Program Development

6.1.1 Develop the Program for online services of Schools Division Office of
Legazpi City

6.1.2 Submit Monthly Accomplishment/Progress Report every first week of

the succeeding month

6.2 Privacy and Confidentiality

6.2.1 Ensure Confidentiality of Information pursuant to Data Privacy Act

 That pursuant to CSC, COA and DBM Joint Circular No. 1, s. 2017, Section 5 and 7,
“Contract of Service refers to engagement of the services of an individual, private firm, other
government agency, non-government agency or international organization as consultant,
learning service provider or technical expert to undertake special project or job within
specific period, services of the contract of service workers are not covered by Civil Service
law and rules thus, not creditable as government service. They do not enjoy the benefits
enjoyed by government employees, such as leave, PERA, RATA and thirteenth month pay.”

7. That the Contract of Service will take effect November 1, 2020 to April 30,
2021 until such program is completed and implemented in the division;
8. That the SECOND PARTY shall perform work at a time, schedule and as the need
arises in the interest of good governance;
9. It is understood that this Contract of Services / Job Order does not create an
employer–
employee relationship between the FIRST PARTY and the SECOND PARTY, that
the services, or any revision herein rendered are not considered and will not be
accredited as a government service;

10. Furthermore, the FIRST PARTY is not entitled to benefits enjoyed by government
employees such as leave, PERA, RATA and Thirteenth month pay.
