Section 9215.5 of the Elections code is applicable.  It was effective January 1, 2019, and
provides as follows:
 
“The proponent of an initiative may withdraw the initiative at any time before the
88th day before the election, whether or not the petition has already been found
sufficient by the elections official.” (emphasis added)
 
Given that as a matter of statutory construction the more specific will govern the more
general, Section 9215.5 (specifically applicable to municipal elections) will govern over
Section 9604 (located in a chapter on general provisions applicable to all statewide and
local elections).  Accordingly, it’s important to take note of this possible tension,
however there are logical arguments that 9215.5 withdrawal procedures govern. (*see
additional explanatory note below)

I wanted to let you know that after trying to find out what other cities charge when they adopt a
tenant protection ordinance (not voter approved fees via an initiative), I only found San Jose’s
ordinance.  They only charge a program fee and not an additional fee for the landlord or tenant
petition hearings.   
 
I believe they were relying on this section of Prop  26:
“(3) A charge imposed for thereasonable regulatory costs to the State incident to issuing licenses
and permits, performing investigations, inspections, and audits, enforcing agricultural marketing
orders, and the administrative enforcement and adjudication thereof.”
 
Council Member Hansen agreed to eliminate the additional hearing fee and just impose the
program fee to cover all costs, and said I could send you this new info.
 
In San Jose, last year they raised their per rental unit program fee from $14 to $30 due to the
cost of administration of the program, so going forward Council may decide to impose a hearing
fee based on program costs. If so, then we can deal with financial hardship, when payment is
due, and if landlord pays when tenant’s petition is upheld.
