1. I am a full time employee of Siocon National high school located at

Barangay Poblacion Siocon Zamboanga Del Norte, working as a English
instructor. in the school mentioned above, under the principal of Mr. Marlon
Micubo.

2. On November 12, 2017 at around 10:30 o’clock in the afternoon, after I

finished recording the quizzes of my students, I decided to go home;

3. I saw Ms. Normida Abdulmin together with her cousin Ms. Marwisa
Abdulmin, waiting outside the gate, I recognized the two because both of
them are under my English subject class. They were talking at each other and
I was just 3 meters away from them doing my time out.

4. Right where the cousins were standing, a black car with a red plate number
MHA6116 stopped in front of them and three men approach the two cousins,
they made them board the black car and went on their way;

5. I did not intervene because Ms. Normida Abdulmin and Ms. Marwisa
Abdulmin were known as rich kids so I assumed those were just their driver
and personal bodyguards and there were many instances that I saw them
being fetch by a black car; so that I nevermind them.

AFFIDAVIT OF ARREST

We, SPO2 Mohaisa D Pillai and SPO1 Ric Ryan Perez, both members of the
Philippine National Police, presently assigned at Siocon Zamboanga Del Norte,
Police Station, do hereby depose and state THAT:

01. That on or about 8:30pm in the evening November 12, 2017, I, SPO2
Mohaisa D. Pillai received a report from Reynold Abdulmin, Richard the father and
uncle of the victims from Barangay Poblacion Siocon Zamoanga Del Norteand he
reported that his daughter and niece were raped.
02. That immediately after receiving the report, we proceeded to the
residence of Reynold Abdulmin and thereat, we saw the victims Normida Abdulmin
and Marwisa Abdulmin.
03. That upon the interview of Normida Abdulmin and Marwisa Abdulmin,
they narrated everything that happen to them about the incident and alleges Dearyn
maitao ,Irvin Nercuit and Adam alasti of the crime rape, wherein they molested
victims.
04. That we invited Dearyn Maitao, Irvin Nercuit and Adam Alasti to go with
us in the Police Station to clarify things which they really acceded.
05. That we informed Dearyn Maitao, Irvin Nercuit and Adam Alasti that
they are being held for allegedly committing the crime of Rape and apprised them
of their Constitutional Rights as stated in the Miranda Doctrine. We then brought
and indorsed the case for proper investigation.
06. IN TRUTH TO THESE WE HERE UNTO affixed our signatures below
to the truthfulness of the foregoing.

CRIMINAL COMPLAINT AFFIDAVIT

I, Mikee Joy Miro, the undersigned, of legal age, and a resident of Barangay
Poblacion Siocon Zamboanga Del Norte, Accuses Mark Lopez, Kelvin Caragan and
Fritz Santiago of the crime Kidnapping, committed as follows:

1. On the 16th day of November 2017 around 9:00 in the evening, I Mikee Joy
D. Miro just finished my night class in BS Criminology , I am walking faster
because my driver is waiting on the gate

2. Upon my arrival on the gate, my driver is not yet there so I take my seat near
the store. While waiting, I played on my cellphone so that I won’t get bored.
A minute after, a black car stopped in front of me, three men went out of it
and went to my direction.

3. A man wearing a red cap, blue leather jacket, and white shirt asked me
“Ikaw ba si Mikee Joy D. Miro” I answered “Oo, kay?” after that everything
is going black.
4. I don’t know how long I am unconscious but slowly I am hearing voices of
men and they are arguing. I slowly opened my eyes and it took a moment for
me to realized that I’m in a room, both of my hands are tied and my mouth is
filled with a cloth. I still shouted to the top of my lungs and men came to see
me.

5. They removed the cloth in my mouth and asked them “kinsa man mo !
Unsay Sala nako sa inyuha ? Huh? Unsay Kailangan ninyu nako? I shouted to
that the three men in front of me. But they replied on me kwarta among
Kailangan! Maghilum nalang ka para dili ka masakitan!.

6. After a days of locking in a room. I lost my faith not until I heard some
noises like guns firing everywhere.

7. A few moments later a saw a police uniform I feel so warm that I know to
my self that I'm not in danger na. Then I saw mother crying I feel so
relieved that I'm safe.because no matter happens God is always our side.

8. After a moment, Police Lieutenant Colonel Crisbel Mendoza called my

attention and made me narrate everything that happened about the incident
and that they wanted me to choose who kidnapped me from those whom
they caught. I instantly identified them later on called as Mark Lopez and
Kelvin Caragan, Fritz Santiago.

9. The three men kidnappers knew that I am the daughter of Mr. Michael
Miro the owner of the Petron gas and MC company.

10. That all these stated herein are true and were stated freely without any force
or intimidation done against me.

11. To attest to the truthfulness of the foregoing, I, Mikee Joy D. Miro,

complainant, attaches my signature below.

1. I am the complaining victim for the crime kidnapping against Mark Lopez
and Kelvin Caragan, Fritz Santiago in the case entitled “People of the Philippines
versus Criminal Case No.123457, Municipal Circuit Trial Court, Municipality of
Siocon.

2. After my thorough thinking of the incident, I have realized that because of

the sacredness that I experience during those times that I am being kidnapped, I
made a rush decision and immediately accused Mark lopez, Kelvin Caragan and
Fritz Santiago of the crime Kidnapping.

3. Since I have known their reason, I completely understand why they

kidnapped me and since they didn’t hurt or injured me, I am permanently
withdrawing my complaint against them. I clear them of whatever responsibility or
liability to me.

4. I hereby inform the Municipal Prosecutor of Siocon that I am withdrawing

my complaint for the crime of Kidnapping in Criminal Case No. 123457 “People
of the Philippines versus Mark Lopez, Kelvin Caragan and Fritz Santiago"
Municipal Circuit Trial Court, Municipality of Siocon.

5. I likewise request the Municipal Circuit Trial Court, Municipality of

Siocon to dismiss with prejudice the said criminal case.

That on or about exactly 9:30 in the morning September 18, 2018, while my
boardmate Miss. Emmalou Rosal was crossing across the street, she was busy
using her cellphone and didn’t notice the black Van AA12345 with a plate number
of MRMR1423 is also crossing. Right there and then Miss. Emmalou Rosal got hit
by the Van and she was already covered with blood. The left shoulder of Miss.
Emmalou Rosal is injured.

FACTS OF THE CASE:

Investigation disclosed that the victim and the suspect were in a relationship.
On August 06,2017, around 9:00 in the evening the Alvarez Asul Alid, and Faisal U.
Ucab, Ryan Guinoo, Alhassa. Sailela having a dinner together, They very happy
because after a days they meet. After a moment Alvarez Asul Alid is silently eat he
never give a topic about his friends. Later on, all of them is already drunk .
Alvarez Asul Alid got angry without any particular reason, he get the gun and
knife and pointing to Faisal Gomez . And faisal Gomez got covered the whole
blood and his friends was very confused and shock. And the victim was
immediately brought to Siocon Memorial Hospital and was pronounced Death on
Arrival by the attending Doctor. The suspect was arrested by the responding
officers and was turned over to the office of the investigation.

On the account of the foregoing, the suspect was placed under arrest and the
charge of HOMICIDE against him will be brought to the attention of an inquest
fiscal for proper disposition and recommendation.

This case will be brought to you by SPO2 Mohaisa Dansalan PiIlai of this

I, Alwina D. Taib, of legal age, student, and a resident of Purok 1 street,

Barangay Datu. Sailela Siocon Zamboanga Del Norte, after having been duly
sworn to according to law depose and say:

That Monshar Sailela has been showing his feelings to me since then. Giving
flowers, chocolates and other things during he is visiting. I did not ask for him to
do so, he just said that he wanted to do it because he wanted to court me.

On September 23, 2019 around 9:00 in the evening, Almonshar Sailela

visited me on my house she ask my my mother to bring me out. And my mother
said okay just don't go anywhere, but I'm not comfortable with him I just go in a
flow only because of my mother.

Right there and then, Almonshar asked to me become his girlfriend. I don’t
know what to do. Because I don't have any affection or feelings on him. After a
few minutes, I never replied on his said he got angry push me! He removed my
clothes and punch me he said kung dili raka maakua mas maayo matilawan sah
tika. I'm so scared on that time I try to fight him but almoshar so strong and
obsessed to me .

When I woke up, it took a seconds for me to realized what happens, I feel
sore and dizzy of what happen. I can't imagine to face Any people of what
happen to me, I run fast and I Saw my Best friend Raisa Abdulmin she ask what
Happen? I said Almonshar rape me! And he force me .

That I am formally charging Monshar Saiela of the crime of Rape.
