ASSUMPTION OF RISKS, RELEASE AND INDEMNITY

1. I acknowledge and agree that in attending any event and other activities run by Newcastle Flyers
Runners Club Incorporated (INC 1601684) (“Newcastle Flyers”), as a participant or a volunteer, there
are risks, hazards and dangers that can cause injury, damage, death or other loss to me or others –
such as:

(a) running risks – for example, losing control and falling to the ground, colliding with objects or
people, tripping or falling down, or encountering other road, traffic, pedestrian or trail
hazards;

(b) health risks – risks to my mental, physical or emotional condition, whether known or unknown
by me and/or Newcastle Flyers. For example, any aggravation of existing health conditions,
heat or cold related illnesses or conditions; dehydration; or other injury, damage, death or
loss, before, during or even after I participate in the event or other activities;

(c) all other risks – any and all other known and unknown risks. For example, risks due to criminal
acts or terrorism, risks associated with the premises or location, decision making and conduct,
and an outdoor/natural environment.

2. I understand and agree that I am undertaking all Newcastle Flyers’ events and other activities at my
own risk. Newcastle Flyers will not be supervising me during the event and/or other activities or at any
time. I agree that I am solely responsible for my own well-being and safety at all times, and will take
reasonable care when participating in such events and activities (including, but, not limited to, when
crossing the road).

3. I understand and agree that participating in these activities requires extreme fitness and endurance,
that I, in conjunction with my physician, am responsible for determining whether these activities are
appropriate for me before participation.

4. I understand and agree Newcastle Flyers may enlist third parties to assist Newcastle Flyers’ to conduct
some of the activities I will engage in. I acknowledge that Newcastle Flyers does not supervise or
control these third parties and is not legally liable or responsible for their conduct.

5. I am voluntarily participating in all Newcastle Flyers’ events or activities and I acknowledge the
inherent risks in connection with the activities. Therefore, I agree that I assume and accept full
responsibility for myself, for the inherent and other risks (both known and unknown) of the activities,
and for any injury, damage, death or other loss suffered by me, resulting from those inherent and
other risks.

6. I release Newcastle Flyers from any and all claims or liabilities that I may have, for any injury, damage,
death, lost property, stolen property, or other loss in any way connected with my participation in
and/or assistance with all Newcastle Flyers’ activities. I understand I agree to waive all claims that I
may have against Newcastle Flyers and agree that I will not make a claim against Newcastle Flyers for
any loss, injury or damage I may suffer.

7. I indemnify Newcastle Flyers against all direct or indirect losses or claims brought by or on behalf of
me, for any injury, damage, death, lost and/or stolen property or other loss in any way connected with
my participation in and/or assistance with the activities.

8. I acknowledge and agree that the disclosures, assumptions of risk, releases and indemnities herein
also extend to any child(ren) of mine that participates in or volunteers for any Newcastle Flyers’
events and/or other activities. I am completely responsible for my child at all times and acknowledge
there are risks to my child(ren) associated with all Newcastle Flyers’ events and other activities.

9. The assumptions of risk, releases and indemnities contained herein are intended to be interpreted and
enforced to the fullest extent allowed by law. If any terms are deemed unlawful or unenforceable, it
will not affect the enforceability of the remaining provisions, and those remaining provisions will
continue in full force and effect. I have carefully read, understand and agree to be bound by terms
herein and acknowledge that it shall be effective and legally binding upon me.
