KNOW ALL MEN BY THESE PRESENTS:

This DEED OF ABSOLUTE SALE is made, executed and entered into by:
 
        Al M. Onds, of legal age, single, Filipino, and with residence and postal
address at Marville Homes, Irisan, Baguio City 2600 hereinafter referred to
as the SELLER
 
-AND-
 
       Leaf Y. Green, Filipino and with residence and postal address at Aurora
Hill, Baguio City 2600, hereinafter referred to as the BUYER.
 
WITNESSETH; 
 
       WHEREAS, the SELLER is the registered owner of a parcel of land
with improvements located at Brookspoint, East Bayan Park, Aurora Hill,
Baguio City and covered by Transfer Certificate of Title No. 123456
containing a total area of Five Hundred (500) SQUARE METERS, more or
less, and more particularly described as follows:
 
TRANSFER CERTIFICATE OF TITLE NO. 123456
 
 
       WHEREAS, the BUYER has offered to buy and the SELLER has
agreed to sell the above mentioned property for the amount of One Million
Pesos (P 1,000,000.00) Philippine Currency;
 
       NOW THEREFORE, for and in consideration of the sum of One
Million Pesos (P 1,000,000.00) Philippine Currency, hand paid by the
vendee to the vendor, the SELLER DO HEREBY SELL, TRANSFER, and
CONVEY by way of Absolute Sale unto the said BUYER, his heirs and
assigns, the certain parcel of land together with all the improvements found
thereon, free from all liens and encumbrances of whatever nature including
real estate taxes as of the date of this sale.

I, Vin E. Gar, Filipino, single, and resident of Trancoville, Baguio


City, Philippines, for and in consideration of the amount of Two Million
Pesos (P 2,000,000.00), paid to me today byTilioSusuman, Filipino, single
and resident ofTrancoville, Baguio City, Philippines do hereby SELL,
TRANSFER and CONVEY absolutely and unconditionally unto said
PakuloPapito that certain parcel(s) of land, together with the buildings and
improvements thereon situated in the City of Baguio, and more particularly
described as follows:

A parcel of untenanted land located in Trancoville, Baguio City with a


residential building and a assessed value of Two Million Pesos.

It is hereby declared that the boundaries of the foregoing land are


visible by means of land survey; that the land is assessed for the current year
at P2,000,000 as per Tax Declaration No. 67234, and the building and/or
improvements , at P 1,000,000 as per Tax Declaration No. 21361, of the City
Assessor of Baguio.

The above described real estate, not having been registered under Act
No. 496 nor under the Spanish Mortgage Law, the parties hereto have agreed
to register this instrument under the provisions of Sec. 194 of the Revised
Administrative Code, as amended.

WHEREAS, the BUYER may assume Home Development Mutual
Fund (HDMF) balance starting on January 20, 2016 including occurrence of
charges until fully paid, except on the event that the SELLER death may
agree to pay half of the unamortized balance to his beneficiary.

THAT the said property is mortgage by the SELLER in favor of


Home Development Mutual Fund (Pag-IBIG Fund) as evidenced by the
DEED OF MORTGAGE executed on December 5, 2015 by, and enter his
notarial register as Doc. No IV; Page 2; Book No. 4; Series of 2015, a copy
of mortgage deed is hereto attached as ANNEX “A”, and made an integral
part thereof.

WHEREAS, the BUYERhave agreed to assume, as they hereby


assume, all the duties and obligations of the SELLER imposed upon the
latter in the afore-mentioned DEED OF MORTGAGE, as if the present
BUYER were the MORTGAGOR in the said DEED OF MORTGAGE.
NOW THEREFORE, for and in consideration of the sum of TWO
HUNDRED EIGHTY THOUSAND (P 280,000.00) Philippine Currency,
hand paid by the vendees to the vendors, the SELLER DO HEREBY SELL,
TRANSFER, and CONVEY by way of Absolute Sale unto the
said BUYER, his heirs and assigns, the certain parcel of land together with
all the improvements found thereon, free from all liens and encumbrances of

This CONDITIONAL DEED of SALE of a PORTION of AN


UNREGISTERED LAND made and executed by and between:

May Melon, of legal age, single, Filipino Citizen, with residence at


53 Honeymoon Road, Baguio City, Philippines, herein referred to as the
VENDOR;

and

Wada Melon, of legal age, single with residence at 142 San Carlos

herein set-forth shall oblige him to return to the VENDEE the amount of the
advance payment/s made plus legal interests;

WHEREAS, the VENDOR warrants that the above-described parcel


of Land is free from any lien and/or encumbrance;

FINALLY, this contract shall be binding and enforceable upon the


heirs, assigns and the successors of the parties herein.

CONDITIONAL DEED OF SALE OF A REGISTERED LAND

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF CONDITIONAL SALE, made and entered into by


and between:

Wate R. Cress, single, of legal age, Filipino Citizen, with residence


and postal address at #41 Upper Engineer‟s Hill, Baguio City, Philippines,
hereinafter referred to as the VENDOR;

-and-

Danu M. Cress, single, of legal age, Filipino citizen, with residence


and postal address at #13 East Bayan Park, Aurora Hill, Baguio City,
hereinafter referred to as the VENDEE;

WITNESSETH:

WHEREAS, the VENDOR is the absolute owner, in fee simple of


that certain parcel of land located in Loakan, Baguio City, covered by
Transfer Certificate of Title No. T-18338, more particularly described as
follows:

A parcel of land (Lot 2-A-6-C, of the subdivision plan, (LRC) Psd-


47132, being a portion of Lot 2-A-6, described on plan, (LRC) Psd-11998,
LRC (GLRO) Rec. No. Civil Res. No. 211), situated in the Barrio of Res.
Sec. “J”, City of Baguio, Bounded on the N., points 2 to 3, by Lot 2-A-5,
(LRC) Psd-11998; on the E., points 3 to 4, by Lot 2-A-7, Psd-11998; on the
SE., points 4 to 1, by Lot 2-A-6-A of the subdivision plan; and on the W;
points 1 to 2, by Lot 2-A-6-B, of the subdivision plan. Beginning at a point

Containing an area of FIVE HUNDRED EIGHTY FIVE (585) SQUARE

WHEREAS, the VENDOR has agreed to sell unto and in favor of the
VENDEE, and the VENDEE is willing and/or agreeable to buy from the
VENDOR, its ownership, rights and interest a portion of the above-
described land with an area of THREE HUNDRED FIFTY TWO (352)
SQUARE METERS with a total consideration of TWO MILLION TWO
HUNDRED EIGHTY EIGHT THOUSAND PESOS (Php2,288,000.00),
Philippine Currency, under the terms and conditions provided hereunder;
Now, therefore, for and in consideration of the foregoing, they do hereby
agree as follows:

1. That upon signing of this Conditional Deed of Sale, the VENDEE shall
pay ONE MILLION TWO HUNDRED THOUSAND PESOS
(Php1,200,000.00), as downpayment;

2. That the balance of ONE MILLION EIGHTY-EIGHT THOUSAND


PESOS (Php1,088,000.00) shall be paid through Philippine National Bank
Loan, Session Road Branch on or before sixty (60) days, or until February 6,
2016, from the execution of this Conditional Deed of Sale;

3. That upon receipt of the Bank Guarantee in favor of the VENDOR, the
latter shall execute an Absolute Deed of Sale in favor of the VENDEE;

4. That failure to pay the balance shall cause the automatic rescission of this
Contract with damages in the amount of ONE HUNDRED THOUSAND
PESOS (Php100,000.00);

5. That the realty taxes and special assessments on the subject property on or
before the date of sale, cost of operation of the documents of sale, and
notarial fees shall be for the account of the VENDOR; while those realty
taxes that shall accrue after the date of this Conditional Deed of Sale, capital
gains tax, documentary stamps, costs of registration, transfer tax, and all
incidental expenses for the issuance of the new title shall be for the account
of the VENDEE;

I, Lemo N. Grass, 16 years old, single , residing at Purok-3 Aurora


hill, Baguio City, after having been sworn to in accordance with the law do
hereby depose and state:

That Fiscal Mariel Choko is the counsel who conducted and


supervised my examination as a witness at her office at Provincial
Prosecutor’s Office, Baguio City, Benguet;

That I am answering the questions herein fully conscious that I do so


under oath and that I may be criminally liable for false testimony or perjury;
The following are the Questions propounded by Fiscal Jesica Pearson
and my answers in English language:

Q1: Do you swear to tell the truth and nothing but the truth?
A1: Yes Sir.

Q2: Are you the same Lemo N. Grass, the private complainant in this case
for Physical Abuse in Relation to R.A. 7610 now pending before the
Regional Trial Court, Branch 1 of Baguio City, Benguet?

A2: Yes Sir

Q3: What is your highest educational attainment?


A3: 3rd year High School at Libertad National High School.

Q4: Do you personally know the accused in this case, Cin N. Amon?
A4: Yes Sir.

Q5: Can you tell us why you personally know Mr. Amon?
A5: He also lives in Purok 3 Libertad. He is our neighbor and their house
is just beside our house. We are friends since I was a child.

Q6: Where were you on January 3, 2016 at about 10:00 o’clock in the
morning?

A6: I was walking home at that time after I had visited my friend Paolo
Balesteros at Purok 1 Aurora Hill, Baguio City.

Q7: Who was with you during that time you were walking home?

A7: I was with my other friend, Ginger.

Q8: What transpired during that time?


A8: I was walking with my friend Ginger. When we reached in front of
Bayambago’s house Marcelo Bayambago who was looking very angry
came out and told me in ilocanowords to quote “ anyatikayatmoaya”
unquote. Then he punched my right portion of my body.

Q9: When he punched you, what did you do?


A9: I didn’t do anything Sir. I could not do anything.

Q10: What did your friend Ginger do?


A10: He did nothing too. We both could do nothing.

Q11: Why do you say that you couldn’t do anything?


A11: Because Cin N. Amon is bigger and stronger than the two of us.
No one dared to fight with him Sir.

Q12: Why do you say that he was angry during that time?

A12: Because when he got out of their house, he was swearing and he
seemed to be pissed off of something inside their house.

Q13: Was Marcelo Amon drunk at that time?

A13: No Sir. He didn’t smell or look like he was drunk.

Q14: Can you tell us how big Marcelo is?


A14: He is 5”6 tall. His body structure is firm and has strong muscles
because he works out sometimes. He acts like he can beat all of us
smaller than him. We are actually terrified by his presence because of
his unpleasant behavior.

Q15: Why do you say unpleasant behavior?


A15: Because whenever me and my friends are joking and laughing, he
just suddenly interrupts shouting at us and telling us to shut our mouths. He
then threatens us that if we are taking about him, we surely would get a
prize from him.
Q16: What prize would this be?
A16: Maybe a punch or a kick.

Attached to this Judicial Affidavit is an original copy of the medical


certificate marked as Exhibit “A”.

Q17: Based on this medical certificate you are showing to us that the
injuries would have incapacitated you for a period of 7 to 10 days?

A17: Yes, Sir, I was actually incapable to join my classes at Libertad


National High School for more than a week due to the pain that I
suffered. The next day after the incident I had bruises and it was
absolutely difficult for me to stand.

Q18: Who issued this medical certificate?

A19: It was Art I. Choke, Medical Officer III at Butuan Medical Center

Q29: Who’s signature is this in the medical certificate?

A29: My doctor, Sir, Dr. Art I. Choke.

Q30: Why did you say that it was Dr. Choke who signed it?

A30: Because I was in front of her when she signed the medical certificate.

Q31: Do you have anything to say, Mr. Grass?

A31: No more, Sir.
