Service Number 179853-2020 STATE OF TERAS AFFIDAVIT FOR ARREST WARRANT __| COUNTY OF DALLAS BEFORE ME, the undersigned authority, on this day personally appeared the undersigned affiant who, after being duly swom by me, on oath stated: My name is C. Walton #8479 and {am a peace officer of the City of Dallas, Dallas County, Texas. 1 he afant have {good reason and do believe that on or about October 9, 2020, suspect Loper, Darrin W/MIIEIIBBd then and there inthe City of Dallas, Error! County, Texas commit the offense of Murder, a violation of Section 19.02 of the Penal Code, a F/ Affant’s belies based upon the following facts and information which AMfiant received from: BY Affian’s personal investigation ofthis alleged offense O ___ a fellow peace officer of the City of Dallas, Dallas County, Texas, who personally participated in the investigation of this alleged coffeis, providing this information to Affiat, and whose information A\fiant believes tobe credible. On October 9, 2020 at approximately 7:35 AM, suspect Darrin Lopez committed the offense of Murder against complainant James Falth, in the 1000 block of S. Waverly Drive, Dallas, Dallas County, Texas. (On October 9, 2020, at approximately 7:35 AM, Dallas Police patrol officers responded to a shooting cal at 1002 S. Waverly Drive, Dallas, Texas 75208. Upon arrival, officers observed complainant James Faith lying on the ground suffering from what appeared to be multiple gunshot wounds, Dallas Fire Rescue arrived at the scene and pronounced the complainant deceased. During the investigation, {twas leamed that the complainant left his residence with his wife, witness Jennifer Faith, to walk their dog. While walking their dog, ‘a masked suspect approached them and shot the complainant, causing his death ‘Muttiple witnesses observed the suspect enter a black Nissan truck and flee the scene immediately after the offense. Detectives received a photo of the suspect venice from one of the witnesses. The vehicle in the photograph appeared to be aback, older model, Nissan Titan truck that had a white "T" emblem on the lower left side of the rear windshield. Detectives interviewed witness Faith who stated, she exited out of her residence with their dog and the complainant followed behind her. Witness Faith stated she heard the sound of footsteps coming up behind them and turned around to observe a suspect pointing handgun at the complainant. ‘The suspect then shot the complainant multiple times causing him to fall on the ground. Witness Faith stated the suspect attacked her, placed duct tape around her hands, and began striking her with the palm of his hands, while she was on the ground. Witness Faith stated the suspect also tried takingher jewelry but was unsuccessful as she screamed for help. The suspect then fled the location. Witness Faith stated she was unable to identify the suspect because he was wearing a hooded jacket or sweatshirt and a blue facemask. Witness Faith was able to confirm thet thee sesiect’s eye color was black. This offense occurred the morning after the complainant and witness Faith celebrated their 15th jedeig anniversary. During the interview, witness Faith gave written censent to detectives for a date extraction of her cellular shane. An snishsis of the cellular phone data revealed that witness Fath was having marital proalems with the complainant. Detectives leached that witness Faith had been in contact with an individual named Darrin Lopez (W/M III referred to as Loper hereafter, who is believed to be her ex-boyfriend from high school and college. Detectives located text messages in which witness Feith described her relationship with Lopez as a fll blown emotional affair” and that Lopez had "a five year plan of how they would be together.” Duringa subject check of Lopez, twas learned that he owns an older model, black Nissan Titan truck that matched the description of the suspect vehicle. A Dallas County District Judge signed a search warrant for Lopez's cellular phone records. Law enforcement officals reviewed the aerial footage and observed a black Nissan Titan truck parked on the property. The vehiele also had a white “T" emblem on the lower left side of the rear windshield, which matched the suspect vehicle used in the murder offense. Based on the information received throughout this investigation, tis beliéved that suspect Dartin Lopez, who is the ex-boyfriend of the complainant's wife, witness Jennifer Faith, traveled from Cumberland Furrace, Tennessee to Dallas, Texas to Murder the complainant.
