TO MEMORANDUM CIRCULAR NO. 2018-008
WITH EXTENSION OF VALIDITY

APPLICATION

COMES NOW, Applicant and unto this Honorable Board, most respectfully
alleges and states that:

1. That applicant is a domestic cooperative duly organized and existing under and
by virtue of the laws of the Philippines with business address at BRGY. 79
MARASBARAS, TACLOBAN CITY, where it may be served with Summons
and other and other processes of the Board;

2. Applicants hereby applies for the issuance of Certificate of Public Convenience to

operate a FILCAB service for the transportation of passengers and freight
within/on the route TACLOBAN CIRT – NEW BUS TERMINAL (ABUCAY)
AND VICE VERSA under one Consolidated/juridical entity pursuant to
Memorandum Circular No. 2018-008;

3. That applicant has a total of 3 members with 3 number of authorized units to

operate on the above mentioned route, to wit:

4. That the above individual members are willing to have their CPCs cancelled in
exchange for a single consolidated CPC in favor of the applicant as proven by the
attached proven by the individual affidavit of conformance.

5. Moreover, ONE (1) of the existing individual franchise as listed-above,

particularly: with Case No: VIII-2014-3126 will expire on March 03, 2020 to be
Extended up to March 03, 2025 is set to expire this year 2020. Relative thereto,
applicant Cooperative also respectfully prays for an extension of the expiring
franchise up until the period allowable or subject to the conditions set forth by
LTFRB Department Order No. 2017-011 or the PUVMP or its subsequent
issuances by the LTFRB.

6. Applicant has a garage located at ____________________________, sufficient to

accommodate all the units of the consolidated CPC pursuant to Memorandum
Circular No. 2017-027;

7. Applicant undertakes to replace the existing authorized units with units which
are compliant with the Omnibus Franchise Guidelines (OFG) and DTI/PNS
standards;

8. Applicant is aware of the consequences should he fail to substitute the

authorized units as per Memorandum Circular No. 2019-_______;

9. Applicant hereto attached the following documentary requirements and marked

as:

Annexes “A”, “A-1” –SEC Registration/CDA Registration and CTC

Accreditation

Annexes “B” – Articles of Incorporation/Cooperation and By-Laws

Annexes “C”- “C”- __________” – LTO OR/CR of units

Annexes “D” – “D- _________” – Affidavit of conformance individual members

Annexes “E” – Government Issued ID of ___________________ as Authorized

Representative

Annexes “F” – Copy of Board Resolution/Secretary’s Certificate of Authorized

Annexes “G” – Clearance of Accounts of individual members

Annexes “H”-“H-___________” – Valid Passenger Insurance of all the units Subject

of Application
 Annexes “I” – “I- ___________” – TCT and/ or Contract of Lease of Garage with
Zoning Clearance

10. Applicant shall abide by the policies, rule and regulations of the Board and the
Department of Transportation;

11. With the consideration and approval of this application, public convenience and
necessity shall be promoted in a suitable manner.

WHEREFORE, premises considered, it is respectfully prayed, after consolidation,

a Certificate of Public Convenience be issued under the name of applicant
corporation/cooperative and let the individual franchises above cited be CANCELLED
AND REVOKED in favor of the Consolidated CPC.

Other reliefs just and equitable under the premises are likewise prayed for.
