1. Ana had been married to Balot for 10 years. Since their


marriage, Balot had been jobless and a drunkard, preferring to
stay with his "barkadas" until the wee hours of the morning. Ana
was the breadwinner and attended to the needs of their three
(3) growing children. Many times, when Balot was drunk, he
shout invectives against Ana and their children. Due to verbal
abuses committed against her, Ana consulted a psychologist
several times, as she was slowly beginning to lose her mind.
One night, when Balot arrived dead drunk, he suddenly stabbed
Ana several times while shouting invectives against her.
Defending herself from the attack, Ana grappled for the
possession of a knife and she succeeded. She then stabbed
Balot several times which caused his instantaneous death.
Medico-Legal Report showed that the husband suffered three
(3) stab wounds. Can Ana validly put up “Battered Woman
Syndrome” as a defense? Explain.

2. Tacio is a 60-year old pedicab driver. While waiting for a


passenger on the road side, he saw Wanda, his 16-year old
goddaughter walking to towards their bathroom located outside
the main house. Tacio was caught peeping through a small hole
in the bathroom door while Wanda was taking a bath. Is Tacio
liable for any crime? Explain.

3. Maria testified that she and Juan are husband and wife, then
being married for 19 years. They have two children. Juan worked
abroad while Maria was a full-time housewife. Juan sent money
to Maria and the children. From this money, Maria was able to
buy household items: television set, refrigerator, karaoke,
washing machine, dining table, and "sleeprite" bed. The family
lived in a house owned by Juan's mother.

On February 17, 2010, Juan and Maria had a heated argument


regarding Maria's supposed indebtedness, to which the family's
television set and refrigerator were used as collateral. Maria said
she incurred the debt to pay her siblings the money she

borrowed in relation to Juan's applications for work. Juan hauled


the family's television set, refrigerator, divider, bed, and dining
table to his parents' house. Maria alleged mental anguish by
reason of the said act of Juan and sued the latter for violation
of R.A. 9262. Is Juan liable? Explain your answer. If yes, under
what specific provision of the law and why?

3. Braulio invited Lulu, his 11-year old stepdaughter, inside the


master bedroom. He pulled out a knife and threatened her with
harm unless she submitted to his desires. He was touching her
chest and sex organ when his wife caught him in the act. The
prosecutor is unsure whether to charge Braulio for acts of
lasciviousness under Art. 336 of the RPC; for lascivious conduct
under RA 7610 (Special Protection against Child Abuse,
Exploitation and Discrimination Act); or for rape under Art. 266-A of
the RPC. What is the crime committed? Explain.

4. Lolita is married to Pedro and they have two children namely


Kier (19 years old) and Lyka (17 years old). At first, their marriage
was a happy and peaceful one but the same turned sour later on.
Pedro had an affair with several women.

On February 6, 2011, Lolita and her children saw their car parked
at the premises of the airport, with her husband and a woman
inside. Since she could not open the door, she went on top of the
hood and punched the windshield and went berserk when she saw
that the woman inside the car was pregnant. As a result of the

incident and the womanizing ways of her husband, complainant


sustained various physical injuries. Can Pedro be indicted for
violation of R.A. 9262 for said physical injuries sustained by Lolita?
Explain.

5. Gwendolyn is a 17-year old minor. On May 2, 2014 at around


6:00 o’clock in the evening, while she was attending the
procession, Mang Nicanor told her “iwas dida kay burod ka” (go
away since you are pregnant). Because of such utterance, she felt
embarrassed and ashamed since there were many persons
present during that time, so she just cried, left the procession and
went home. She then sued Mang Nicanor for violation of Sec.
10(a), R.A. 7610. Will the charge prosper? Explain.

6. AAA (a street child) narrated that in the year 2007, she worked
as a house helper in Mandaue City. In March 2008 she stopped
working as a house helper and transferred to Cebu City. She
stayed with Batman, a cousin. Batman, introduced AAA to his
friend Wonder woman who works at a club. He likewise convinced
said friend to give AAA a job. When Wonder woman found out that
AAA was no longer a virgin, she offered AAA work. AAA knew that
Wonder woman worked in a disco club. Despite such, she
accepted the job. AAA agreed because she needed the money in
order to help her father. AAA recalled that when she had sex with
her first customer she was paid P200.00 and given an additional
P500.00 as tip. For the first few weeks, Wonder woman provided
customers for AAA. Is there a violation of the law in this case?

7. On March 9, 2015, the 8th Regional Criminal Investigation and


Detection Unit (8RCIDU) received a letter-complaint from a
concerned citizen regarding prostitution activities in RITA’s
Videoke Bar. The following day, a surveillance was conducted on
the said establishment with civilian agent, JJJ, posing as a regular
beer-drinking customer. JJJ was allowed to table a female worker
in the bar named “Lyka” who just turned 18 years old on that day.
During their conversation, “Lyka” told him that she could be taken
out for sex for the price P2,000.00. This is without knowledge of
the owner of the establishment as Lyka wanted to earn more than
her usual wage. Is there a violation of the law in this case?
Explain. If yes, who are liable and what specific provision is
violated?

8. Perla, a Filipino residing in Australia, offered her friend Patricia a


job abroad telling the latter that she will work as a nurse at St.
Michael’s Hospital in Australia. When Patricia arrived in Australia
she was transported to New South Wales and was made to work
in a naval base as cook. She works 20hours a day and she is not
paid for the work done. She cannot go back home as her passport
was confiscated by Perla. Upon her rescue, Patricia sued Perla,
one for Trafficking in Persons and another for Acts Promoting
Trafficking for the confiscation of her passport. Will the charges
prosper? Explain.
