CONTRACT AGREEMENT

1. PARTIES
Labour Hire Company (LHC) : ____________________________________________________________

And
(the Host Employer) Newland Greens
ABN: 49 409 486 089

The Parties agree to perform the following work:

Season Setup, Maintenance, Picking and Packing Dragon Fruits
On the property/ies of Newlands Road, Wamuran. 4512.

2. GENERAL
The LHC agrees to complete the work no later than:
A. ______________ / _______________ / ________________ (dd/mm/yyyy) or
B. The LHC agrees to complete ongoing work as required by the Host Employer until
otherwise notified.

The LHC agrees that it will only supply employees who are appropriately and
adequately trained to undertake the work set out in this agreement. In the event that
the Host Employer requires replacement employee/s the LHC agrees to use all
reasonable attempts to replace the employee within 2 business days.

The LHC agrees to supply all plant/tools, materials and labour needed for the work to
completed. The provision of Plant and materials includes the provision of personal
protective equipment (PPE) which may be required under the Work Health and Safety
Act and Regulations 2011.

The LHC agrees that it is not an employee of the Host Employer.

 The parties agree that the LHC employees are at all times employees of the LHC and not
employees of the Host Employer. The LHC agrees that it is responsible for the quality of
work undertaken by its employees and must remedy any defects, disputes, or claim
made by its employees.

3. PICKING
LHC have enough pickers to pick from early morning to finish, number of pickers from
LHC at least 10 pickers.
LHC must have one person to control all his/her pickers. (Supervisor). One person to
record all picking trays of every picker for LHC.
Grower must provide all the empty trays on the field picking, and have one driver to
take picking trays to the cold rooms. This driver supplied by Grower.
PAYMENT
Picking tray are $1.95 each.
The commission for the LHC is 5.5% ($0.10)
The Workcover 3% ($0.05)
The superannuation 9.5% ($0.18)

The Good Services Tax 10% ($0.22)

Total includes GST are $2.50 per tray.

4. PACKING
LHC must have at least 10 packers for packing.
LHC must have one supervisor experienced to control all packers.
Grower must have two or three in the packing shed to do checking and working from
the round table to the cold room. These persons belong to the grower or supplied by
LHC.
PAYMENT
Packing box are $0.78 each
The commission for the LHC is 5.5% ($0.04)
The Workcover 3% ($0.02)
The superannuation 9.5% ($0.07)

Total includes GST are $1.00 per box.

The quality of packing is very, very important for the market.

LHC must have one good and strong supervisor to control strongly all packers, any bad
packers must be disciplined and sorted out immediately.
LHC must guarantee to have enough pickers and packers for the grower to the end of
the season before the law.
