3 just want to, just very quickly, explain what has

4 happened.

5 THE COURT: Oh, Mr. Bolz, before - you

6 proceed, the one thing I do want to see is the

7 notice of today's hearing. I've looked the

8 docket sheets and couldn't find it.

9 I just want to make sure that the Fe

10 notice of hearing that was prov~

11 defendants, who

12 MR. BOLZ: Let's special setting

13 hearing entered by, Judge Ferrara on

14 June 2 nd ,

16 MR. Honor, just - the case was

17 remanded the - to this court on Thursday.

18 did not get the order until -

20 When the order came in, I wrote to -sent an e-

2 mail to Laurence Schneider and Stephanie Schneider

'y and advised them that the hearing was going to go

23 forward. And on 4:09 p.m. Friday, I received an e-

24 mail - I haven't shown it to the Court, but it's

25 short.

2 I am in Phoenix doing depositions and will not be

3 back in town until Thursday of next week. Please

4 note that I will be filing a notice with the Court.

4 MR. BOLZ: It is, I think, manifest that we're

5 entitled to the relief. We're - this is a ten-y~ r

6 HELOC loan started in July of 2006. The princ~ p ~


7 balloon became due at the end of

8 Payment wasn't made prior to

9 valorem taxes have not been paid.

10 monthly payments under the mort have not been

11 paid.
12 All defaults ares '.m the complaint.
13 The notices ly sent to the
14 Schneiders. · attorney for eight months,
15 and then he ~a~ from their representation.
16 They have ~ ¥epresented since May 1"'.
17 The amQJ;J./ t of the - they basically, the
18 Schne· drew - or, Mr. Schneider drew down the
19 QC loan within about three years of it being
20 sued. And it was drawn down.
2 It fluctuated. The principle balance -

22 ~ fluctuate between a hundred eighty-eight thousand,

23 a hundred ninety-five thousand. At the time that


24 they went into default, the number is exactly what
25 - it's a hundred and eighty-eight thousand.

1 No. What? Whoa. One million. One million,

2 four hundred eighty-eight thousand, five hundred

3 fifty-four dollars and seventy-six cents.

4 The interest on that amount from March 16 th •

5 And that's when they - the last payment came in o

6 April 9t\ but it was dated back to March - 15t .

7 And so, they have not paid any interest from

9 And the interest for the

10 fifteen months. It's about -

11 thousand, six hundred forty llars and fifty-

12 two cents.

13 And the - unpaid rem taxes for the

14 three years are · ---s ~ x thousand, eight hundred

15 seventy ninety-three cents.

16 We are no ~veeking any additional costs, like

17 late charge Jr late fees or anything like that.

19 taxes. That's all we're seeking.

20 We - if you read the note and the mortgage,

2 they make it eminently clear that we are entitled

'y to those three elements of damages. We are also

23 entitled to attorney's fees.

24 But, we are going to extend and have the court

25 reserve jurisdiction on attorney's fee. We'll deal

1 with those at a future date.

4 know, been set out by affidavit. We filed a

5 complete statement of the loan history, which is
