The UCB must strive to develop legal awareness and access to justice for the people,
and to advance the rule of law in the country. As it is important to establish work plans,
methods and a strategic plan for achieving its goals, the National Conference on Justice
Sector Coordination for Rule of Law was held on March 7-8, 2018. It was attended by gov-
ernment delegates, the representatives of the UN organizations, national and international
experts and representatives from civil society organizations. I am pleased to oversee this
UCB’s Strategic Plan which has been drawn and published based on outcomes of the Con-
ference.
I am confident that this plan will contribute to better judicial services and ensure
respect for the rule of law and serve as a vital bridge to better coordination among different
justice actors.
The UCB is committed to enhancing access to justice for all the people of Myanmar.
We will work in collaboration with the relevant departments and organizations, develop-
ment partners and civil society organizations including those concerned from the relevant
sectors for implementing the 4 Goals and Work Plans of this Strategic Plan.
This Strategic Plan of the UCB was produced under the guidance of H.E. U Tun
Tun Oo, the Union Attorney General, in his capacity as Chairperson of the UCB and of
H.E. U Win Myint, Union Deputy Attorney General, in his capacity as Vice Chair of the
UCB and Daw Nu Nu Yin, Permanent Secretary, in her capacity as Secretary of the UCB.
The UCB sincerely thanks the Working Group Team Leader, Deputy Permanent
Secretary Dr. Thi Thi Myint and the Working Group team members, the Conference
participants from different ministries, the Sub Coordinating Bodies for the States and
Regions, national and international experts, civil society representatives, development
partners, (including among others DFID, UNDP, European Union, My Justice, USAID,
and Denmark), the Advisory Group to the UCB, and everyone who contributed to pro-
ducing this Strategic Plan.
The Union of Myanmar has embarked on a transition to the democracy and is com-
mitted to developing the rule of law as a top priority for the country. We firmly believe that
sustainable peace and development must be grounded on rule of law. Only when public
trust is established, will the rule of law prevail in the country.
In 2013, the first ever seminar on the rule of law was jointly organized by the Union
Attorney General’s Office and the European Union. Since then, institutions have developed
their own strategic plans and civil society organizations have emerged. A legal aid system
is being established and the legal profession has come to recognize the need to modernize.
International development partners acknowledge and accept that their support is impor-
tant for the democratic transformation process as well as the development of the rule of
law and the justice sector of Myanmar.
Rule of Law Centres were designed and launched under the leadership of the State
Counsellor when she was the Chair of the Hluttaw’s Rule of Law and Tranquility Com-
mittee, with the support of UNDP. Rule of Law Centres currently operate out of hubs in
Yangon, Mandalay, Taunggyi and Myitkyina in order to raise legal and civic awareness
among the people. The British Council’s My Justice Programme supports Justice Centres
in Yangon, Mawlamyine, Taungoo, Hpa-An, Taunggyi, Mandalay with European Union
funding and provides legal aid for the poor who are accused of a criminal offence.
In February 2017, the Government established the Union Coordination Body for
Rule of Law Centres and Justice Sector Affairs (hereinafter UCB) to improve cooperation
among justice sector institutions and local and international organizations. The Govern-
ment designated the Union Attorney General as the Chairperson of the UCB, with seven-
teen members from institutions including the Hluttaw, the Union Supreme Court (OSCU),
the Ministry of Home Affairs, the National Human Rights Commission and civil society
organizations, including the Bar Council and educators. Recognizing the complexity of
On May 15, 2017 the UCB established the Advisory Group of international techni-
cal experts to seek necessary advice for its work. It also set up a secretariat and a working
group to achieve its goals effectively.
A Strategic Plan was drawn up based on research, the experience of its members
and consultation with stakeholders. In particular, this Strategic Plan has been inspired
by the Myanmar Sustainable Development Plan (MSDP) and has been prepared in con-
formity with the coordination framework established by the Development Assistance
Coordination Unit (DACU).
B. Planning Methodology
Key justice institutions - the Union Supreme Court, the Union Attorney General’s
Office, and the Myanmar Police Force - have already established their strategic plans to
achieve their goals. With respect to the rule of law process, the UCB’s Strategic Plan will be
formulated with action plans that reference work currently implemented by the relevant
departments and organizations in order to ensure better cooperation in achieving justice
sector reform.
In October, 2017, a Working Group of the UCB was formed to develop the draft
UCB Strategic Plan. Conference Discussion Papers prepared by the Working Group were
discussed at the National Conference on Justice Sector Coordination for Rule of Law. The
Papers were based on the current challenges highlighted in research into Myanmar’s Jus-
tice Sector.
At the Conference, Professor Sir Jeffrey Jowell QC, legal expert from the UK, ad-
dressed issue of “Building a Legal System that Delivers Justice.” Dr. Diani Sadiawati pre-
sented “Indonesia’s experience of developing a national access to justice strategy” that re-
inforced the importance of including civil society in developing the national strategy and
policies.
We will strive to improve the trust and cooperation between civil society and justice
services providers through the promoting of legal awareness and access to better justice ser-
vices for the people, in line with this Strategic Plan. The aim is to implement this Strategic Plan
effectively with the cooperation of local and international organizations working in the area of
rule of law and justice.
Our mission is to promote the rule of law and to foster justice that is
responsive to the people of Myanmar. Our mandate is to strengthen
the justice sector by building coordination, public trust, and increas-
ing knowledge and planning.
A. Strengths
The UCB is chaired by the Attorney General of the Union and includes officials
from the Parliament, the Union Supreme Court, relevant government ministries, the Na-
tional Human Rights Commission, law professors, advocates and representatives from
civil societies. It is well connected to donor partners and international technical expertise
through its international Advisory Group. As the UCB is formed with representatives from
the respective sectors, this diversity becomes a strength for coordination processes. In ad-
dition, it allows for regular coordination and information sharing among the Union and
State/Regional levels and stakeholders.
The respective Region/ State SCBs are participating actively in the rule of law and
justice sector affairs and solving the public complaints with regard to the justice sector as
well.
Some members of the UCB Working Group have experience in developing and
implementing strategic plans in their own institutions. The UCB Secretariat, based in the
Union Attorney General’s Office, has experience in developing and implementing that in-
stitution’s Strategic Plan.
B. Weaknesses
The UCB needs to develop standardized basic principles, work plans and operating
procedures to implement its performance. While the Union Supreme Court, the Union
Attorney General’s Office, and the Myanmar Police Force have been implementing their
strategic plans respectively, the UCB is still facing a lack of technology, human resources,
financial and infrastructure needs in order to develop the rule of law and justice sector
affairs.
Currently, the financial needs of the UCB are met almost entirely by the Union
Attorney General’s Office from its existing Budget. Without resources of its own, it will
be difficult for the UCB to maintain its links to its local units, the SCBs, and to deliver its
strategic actions across the country. Informal resource sharing among member institutions
will not support steady reform.
Moreover, unless frameworks and procedures of the UCB and members have been
established clearly, it will be difficult for the UCB to implement its performances. Ulti-
mately, it is also necessary to develop effective cooperation among the relevant organiza-
tions for strengthening the rule of law and justice sector affairs.
C. Opportunities
The Government is committed to developing the rule of law as a top priority for
the country. The State Counsellor, in delivering the keynote address in the Conference,
showed her continuing leadership on justice sector reform.
As already noted, the Hluttaw’s Rule of Law and Tranquility Committee, then
chaired by the State Counsellor, worked with international partners, Rule of Law Centres
and justice institutions to reform the Justice Sector. This performance was an important
first step for the Justice Sector reform process.
As the UCB was established by the Government through the official notification
of the President and includes officials from the Parliament, the Judiciary, the Executive,
experts and representatives from civil societies, the UCB will be in a position to develop
extensive cooperation for the rule of law and justice sector affairs.
D. Threats
Research shows that some people have little confidence in the country’s ability to
meet their justice needs. Due to a lack of access to justice for all the people, public use of
the formal justice system is low. This awareness of the root causes of dissatisfaction with
the justice sector in Myanmar allows the UCB to frame its work as being responsive to the
needs of its people.
