The patent-at-issue, U.S. Patent No. 7,500,202 (“Gerba”), which was filed on September
30, 2002 and claims a February 4, 1998 priority date is directed to a remote control for
navigating content presented on a display device, wherein the remote control includes at least
three groups of operation controls buttons, each group being located on different sides of the
remote control, and wherein at least one operation control from one group may be used in
conjunction with at least one other operation control from another group.
U.S. Patent No. 5,805,256 (“Miller”), filed on February 27, 1995 without any claim to an
earlier priority date, relates to a remote control for transmitting instruction signals to a video or
audio device, wherein the remote control includes a front, back, and bottom sides, each side
having operation controls, and wherein a remote control user may perform an operation by
pressing an operational control button from one side of the remote control and another operation
control button from a different side of the remote control.
A sample claim chart comparing Gerba to Miller is provided below.
1.pre. 1. A remote control for Miller discloses that “[i]n accordance with the illustrative
interacting with a navigation system embodiments demonstrating features and advantages of the
that allows content presented on a present invention, there is provided a remote control for
display device to be navigated in an issuing commands to equipment that handles a video or audio
organized and categorized fashion, the signal.” Miller at col. 2:11-14.

1.d. a programmable controller, the Miller discloses that “…, microprocessor 66 will issue a pulse
controller operative to receive an sequence defined by the instructions contained in the look-up
indication that a control was selected table along line 76, which is coupled to driver 78. Driver 78
and instruct the infrared transmitter to applies a pulsed, constant current having a pulsed waveform as
transmit an infrared signal suggested by line 76 to light emitting diode 80. Diode 80 is
corresponding to the control selected, designed to transmit infrared light having the pulse waveform
dictated by line 76.” Miller at col. 5:18-24.
1.e. wherein the remote control is Miller discloses that “…, the viewer can grasp bar 10 with the
configured to be grasped by one hand thumb comfortably poised over thumbswitch 44, and the four
of a user with a thumb of the user in other fingers comfortably poised over the finger depressions
