Narrative
***BWC***

On 11/10/18, at approximately 0930 hours, I, Office J. Lopez P# 15471, working as marked patrol unit 2O3, was sent to a call for service located at
7198 Los Banderos Ave., Las Vegas, NV 89179. Details read that the PR's neighbor came over to their residence due to an argument in their home
between family. The neighbor threatened the PR to bring his firearm over and he had also pushed the PR. Officers T. Vaughn P# 8417 and S.
Baltierres P# 17246 also responded to the call.

Upon arrival I met with the PR Weslie Robles, DOB PII /94. Weslie stated that her father, Cesar Ayala-Ortiz, and brother, Steve Ortiz, were in a
verbal argument when their neighbor, later identified as Darius Brown, entered their home, just past the threshold, and told them to shut up.
Weslie told Darius to leave and started to push him out of her home. Darius pushed Weslie, causing her to stumble backwards, then told Weslie,
Cesar, and Steven, who were also present, that he was going to return to their home with his firearm and shoot them.

Officers went to Darius' home located at PRVCY . Darius stated he was awakened by his daughter stating that the neighbors were
arguing. Darius heard the neighbors loudly arguing and walked out of his home and walked to Weslie's home. Darius stated the front door was
open and he did not see anyone in the home. Darius entered the home and told Weslie's family to shut up. Weslie walked down the stairs, saw
Darius and she told him to get out of their home. Cesar and Steve walk into the room and also tell him to leave. Weslie places her hand on Darius'
chest and starts to push Darius out of their home. Darius swipes Weslie's hand off his chest and tells her not to push him. Darius told Cesar to
come outside and talk to him to handle it like men. Darius ended up leaving the residence and went back into his home. Darius added, at no time
did he ever say he was going to return and shoot Weslie, Cesar, Steve, or any other person in the household.

Cesar was not originally home but arrived home while officers were still present. Officer Baltierres spoke with Cesar Ayala-Ortiz, DOB PII /75.
Cesar's story corroborated with Weslie's.

Weslie wanted to press charges for battery against Darius. Officers facilitated a Misdemeanor Citation for Weslie to sign against Darius. Darius
was cited and released.

Weslie refused to complete a voluntary statement at this time and said she would complete one at a later date.

No injuries were observed on Weslie and she declined any medical treatment. No pictures were taken of her at the time officers were at the
residence. At approximately 1514 hours today I went to Weslie's work and took pictures of her, under event #LLV181100043145. The pictures were
uploaded onto OnBase.

Personal Identifying Information

The record(s) you seek contain personal identifying information.

NRS 239.001 provides that public records are open to inspection.

However, NRS 239.010(1) expressly creates exemptions to the disclosure of
records falling under various statutes, including NRS 239B.030. NRS 239B.030
makes “personal information” confidential. NRS 603A.040 defines “personal
information” to include social security numbers, driver’s license numbers,
account numbers, and the like.
Here, because the record(s) you seek contain confidential personal
identifying information, they have been redacted.

Privacy Interests

The record(s) you seek contain information the disclosure of which would
constitute an unwarranted invasion of a person’s privacy interests.

In Reno Newspapers v. Sheriff, 126 Nev. 211, 218, 234 P.3d 922, 927
(2010), the Nevada Supreme Court recognized that an individual’s privacy must
be balanced with the public’s general right to open government, “especially
because private and personal information may be recorded in government
files”). Later, in Clark County Sch. Dist. v. Las Vegas Review-Journal, --- Nev. ---,
429 P.3d 313, 319-20 (2018), the Court adopted a balancing test in which the
burden shifts to the requester of a record if the public agency demonstrates a
“nontrivial personal privacy interest” including “intrusion[s] into a person’s
reasonable expectation of privacy, seclusion, or solitude.” Privacy interests
include information that may cause “embarrassment, shame, stigma, [or]
harassment” or “endangerment, or similar harm.” Las Vegas Metro. Police Dep’t
v. Las Vegas Review-Journal, 136 Nev. Ad. Op 86, --- P.3d --- (2020). Medical
information, personnel files, details about sexual orientation, and other
information about a person’s life give rise to privacy interests. Clark County
Office of the Coroner/Medical Examiner v. Las Vegas Review-Journal, 136 Nev.
Adv. Op. 5, --- P.3d --- (2020).

Here, the record(s) you seek contain information the disclosure of which
would constitute an unwarranted invasion of a person’s privacy
interests. Therefore, they are confidential and must be withheld or redacted.
