FACTS:

In the afternoon of March 22, 1972, Jaime Vicente was heading home aboard a 6x6 truck. He
later passed by his cousin Fermin Padirayon who flagged him down and road the truck. Along the ride
Padirayon allegedly grabbed the steering wheel of the truck hitting and killing Dionisio Lacuta after
Padirayon remarked that he was the guy who hacked him a few years back. Padirayon then fleed and
Vicente reported the hit and run in the municipality the next day. Police, the doctor and municipal
officials then identified the dead body.

The trial court used the statement of Vicente and used him as a state witness. Later on
Padirayon was sentenced with murder by the RTC. The case was then lifted to the SC.

ISSUE:

Whether or not Fermin Padirayon is guilty of the murder of Dionisio Lacuta?

RULING:

NO, The accused was acquitted his guilt has not been proven by the RTC.
