Intro: Good day everyone. This video will be about the section
12 of the article III bill of rights of the 1987 constitution.

Scene 1 (Crime commission)

*On November 27, at around 4 P.M., Mr. Nool of Brgy.
Matatalaib was found dead by her neighbor, Ms. Vioya, after
hearing screams at his residence and seeing a man come out of
Mr. Nool's house with blood on his hands. She then hurriedly
checks the house of Mr. Morales to see what happened but
was surprised to see the victim on his kitchen floor lying dead
and immediately called the nearest police station to report the
incident.

Scene 2 (Crime scene investigation)

*On the crime scene, the investigators found the victim's body
woth a stabwound on the side of his chest on the kitchen floor
and found signs of robbery on the place*

Scene 3 (Arrest warrant request and issuance)

*Request of warrant of arrest from the judge.*
Scene 4 (Arrest)
*Police knocks on the suspect’s door/gate*
Rivera: Sino po sila?
Police 1: Good morning po ma’am. Police inspector Del Rosario
po ng Tarlac Police station. Andyan po ba si Jerson nool?
Rivera: Opo. Andito po yung kapatid ko. Bakit po?
Nool: *goes to the gate* Sino yon?
Del Rosario: Police inspector Del Rosario po ng Tarlac Police
station. Andito po kami para arestohin ka sa kasong robbery
with homicide. Ikaw ay may karapatang manahimik at di
magsalita, anumang sabihin mo ay maaring gamitin laban sa
iyo. Ikaw ay may karapatang humingi at magkaroon ng abogado
sa harap ng anumang napipintong interogasyon ng pulis, at
karapatang mabigyan ng libreng abogado kung hindi mo kaya
kumuha.

Scene 5 (Secret detention)

*Police takes the suspect to a secret detention facility and
forces him to confess for committing the crime*
Nool: Sir, nasan po tayo? Di ba dapat sa police station nyo ako
dadalhin?
Bondoc: Andito tayo para paaminin ka sa krimeng ginawa mo.
Nool: Sir bat dito nyo gagawin yan?
*Police tortures the suspect*
*suspect screams in agony trying to convince the policemen of
his innocence*
Nool: Sir wala po talaga akong alam. Please po pakawalan nyo
na po ako.
Bondoc: Umamin kana. Alam naming ikaw ang nanloob at
pumatay kay Morales!
Nool: Sir, wala po akong alam. Wala po akong pinapatay na tao.

Scene 6 (confession)
Nool: Tama na po. Aamin na ako. Noong araw na 'yon plinano
nakawan yung bahay na 'yon dahil alam kong wala yung may ari
nung bahay na 'yon pag ganong oras kaso pagkapasok ko bigla
nalang siyang lumabas ng kwarto nya tapos di ko na alam yung
mga nangyari naaalala ko nalang tumakbo ako palabas na may
dugo na yung kamay ko.

Scene 7 (suspect with his lawyer)

Nool: Tulungan nyo po ako ma'am, ayaw ko po makulong.
Paguio: Tutulungan kita basta maging honest ka lang sakin.
Sabijin mo sakin ang lahat ng nangyari. Ano ba ang nangyari?
*Nool tells his lawyer of everything that happened and what he
did.*
Paguio: Okay pag-aaralan ko ang kaso mo para matulungan ka.
Basta wag kang basta basta sasagot pag may nagtatanong,
sabihin mo ako ang kausapin. Wala ka pa namang nasasabi sa
mga pulis no?
Nool: Paano po 'yon ma'am? Umamin na po ako sa mga pulis.
Paguio: Bakit ka umamin?
Nool: Pinilit po kasi nila akong umamin sir, dinala po nila ako sa
kung saan tapos binugbog ako hanggang sa umamin ako. Heto
po yung mga pasang nakuha ko sa pambubugbog nila.
*Nool shows his bruises to his lawyer*
Paguio: Ha??? Bawal yung ginawa nila sayo.
Nool: Paano po yun ma'am, makukulong na ba ako sa pag-amin
ko?
Paguio: Hindi. Tulad nga ng sabi ko sayo, bawal yung ginawa
nila sayo. Ano man ang inamin mo sa kanila inadmissible sa
korte 'yon.
Dahil sa ginawa nilang 'yon pwede natin silang kasuhan. Ang
dapat mong gawin nyan ay ipa-medical mo yang mga pasang
nakuha mo dahil gagamitin nating ebidensya yan laban sa
kanila.
Ang tanong, naaalala mo pa kung sinu-sino ang mga gumawa
sayo nyan?
Nool: Hindi ko pa alam mga apleyido nila e
Paguio: Pero matuturo mo ba sila kung makakaharap mo sila?
Nool: Opo
Paguio: Sige, akong bahala sayo.

Scene 8 (Court)
*Suspect and the policemen who tortured him in front of the
court*

Section 12 of Article III Bill of Rights of the 1987 Philippine

Constitution
(1) Any person under investigation for the commission of an
offense shall have the right to be informed of his right to
remain silent and to have competent and independent counsel
preferably of his own choice. If the person cannot afford the
services of counsel, he must be provided with one. These rights
cannot be waived except in writing and in the presence of
counsel.

(2) No torture, force, violence, threat, intimidation, or any

other means which vitiate the free will shall be used against
him. Secret detention places, solitary, incommunicado, or other
similar forms of detention are prohibited.

(3) Any confession or admission obtained in violation of this or

Section 17 hereof shall be inadmissible in evidence against him.

(4) The law shall provide for penal and civil sanctions for
violations of this section as well as compensation to and
rehabilitation of victims of torture or similar practices, and their
families.
