COMPLAINT-AFFIDAVIT
I, VICTORIANO DE LEON SY, of legal age, Filipino with postal address
at 534 Pitong Gatang St., Tondo, Manila, after being duly sworn to in
accordance with law, hereby depose and say:

1. I am filling appropriate charges against a certain Jomer B. Delos

Santos of legal age, Filipino, a casual employee of the City Treasurer’s
Office, Pasay City and Manuel Leycano Jr. also of legal age, Filipino, City
Treasurer of the City Treasurer’s Office, Pasay City. Both Delos Santos and
Leycano Jr. Maybe serve with summons and other processes at the Office
of the City Treasurer Pasay City Hall, Pasay City;

2. The basis of this complaint is the Letter dated February 13, 2020
of Manuel E. Leycano Jr., City Treasurer, Office of the City Treasurer, Pasay
City, requiring me to explain within fifteen (15) days to surrender the
original copies of the Official Receipt Nos. 933715 dated 27 September
2019 and 993504 dated 16 January 2020 issued for the payments to the
property covered by Tax Declaration No. C1-070-0004A payed for the
property owned through purchased of the ascendants of Ruby Sy from
Arthur Ang Sy.

3. According to Manuel E. Leycano Jr., my act in paying the property

taxes for CY 2020-2021 was not authorized and the basis of his contention
is the letter sent by Arthur Ang Sy on January 24, 2020.

4. Further, it was stated therein that my act in paying a such is

unacceptable to Arthur Ang Sy and the latter is not comfortable for the
payment I made in his favor, thus, Arthur Ang Sy insisted to cancel my
payment.

5. Thus, this complaint.

6. The letter dated 13 February 2020 is tainted with fraud on the

following reasons:

i. There were no conflicting issues on the real property sought by

the payment of real property taxes because the same is already
owned by the parents of Ruby Sy, who happened to be my
cousin;

ii. It is impossible for Arthur Ang Sy to write a letter concerning a

protest for my payment because Arthur Ang Sy is already dead.
 How come that a dead person exercising an action who can only
be done by a living person?;

iii. Assuming arguendo, that the same letter truly sent by Arthur
Ang Sy, the tenor of the same seems to be favorable to him;

iv. Lastly, why the Office of the City Treasurer did not attach the
alleged January 24, 2020 letter as its reference in writing the
letter dated February 13, 2020.

7. I respectfully submit that this is complaint was clothed with an

authority given to me by Ruby Sy re to claim the house and lots inherited by
Ruby Sy, to prove this a copy of Special Power of Attorney is hereto
attached as Annex “A”;

8. For the information, Ruby Sy is the sole heir of Hwa Sy

(deceased), the lawful owner of the properties situated at 129 Moana St.,
Pasay City and at 132 Vahalia St., Pasay City;

9. Joe Ching Sy, Victoria Ching Sy, Rosario Ching Sy and Johnny Sy,
are the siblings of Ruby Sy. Sometime after their deaths I aware that the
aforesaid properties were left abandoned;

10. However, when I learned about a selling transaction of their

properties, I immediately informed Ruby Sy who is then in the USA, and I
requested her to come home and make an action to verify such transaction
and in case there was, to reclaim it;

11. Ruby went home from USA, and by virtue of her authority I
immediately went to Pasay City Real Property Tax to verify the status of the
properties and to pay the 2020 tax therefor, but while paying the taxes, I
chanced upon an unidentified lady who was also paying the property tax of
my cousin’s house and lots;

12. When I tried to talk to her and ask her representation, said lady
told me that someone just ordered her to pay the tax but I lost a chance to
verify that someone for she left in a hurry;

13. Sometime thereafter, an employee of Pasay Real Property Tax

arrived to my house carrying a document for my signature and upon
reading thereof, I learned that it was a document for denouncing or waving
my payment for my cousin’s property;

14. In that juncture, I refused to affix my signature for security

reason. To prove this a copy of the letter dated 13 February 2020 is
attached hereto as Annex “B”.
 15. The employee who delivered to me such letter is Jomer B. Delos
Santos, a Casual Employee of the City Treasurer Office. A photocopy of his
Identification Card is attached hereto as Annex “C”;
16. While the person who signed the letter is Manuel Leycano, Jr.,
the City Treasurer of the Office of the City Treasurer, Pasay City;

17. It is unusual that an employee of a government would send a

letter just to favor a private person who is claiming rights over the property
of my cousin;

18. It should be the owner itself or its authorized representative

who should make an action on his/her behalf, assuming rights over his/her
truly exists;

19. However, such an act cannot be done by the claimant himself

nor his authorized representative on the reason that Arthur Ang Sy is
already dead;

20. My cousin knew about it because said deceased person was the
owner of the property before her parents bought the same from him;

21. Secondly, the properties subject of this letter is still abandon and
no one appears to be the owner or claimant of the same;

22. I am executing this affidavit to attest to the truth of the

foregoing facts and for the filing an appropriate charges against Manuel E.
Leycano Jr. and Jomer B. Delos Santos.
