COMMITTEE REPORT

SUBJECT:

1. LETTER DATED SEPTEMBER 4, 2019 OF HON. MANUEL N. MAMBA, PROVINCIAL

GOVERNOR, RE: CONFIRMATION OF THE APPOINTMENT OF ATTY. xxxx AS THE
PROVINCIAL LEGAL OFFICER

FINDINGS/COMMENTS:

The qualifications, powers and duties of a Legal Officer are enumerated under Section 481
of the 1991 Local Government Code. Said provision provides

For consideration before this Committee is a letter coming from the Office of the Governor
regarding the confirmation of the appointment of Atty. xxx as the Provincial Legal Officer of
the Provincial Government of xxx. Before discussing the legal issues involved, a review of
factual antecedents is helpful.

1. On July 29, 2019, the Sangguniang Panlalawigan received a letter dated July 1, 2019
coming from the Office of the Governor transmitting the appointment papers of Atty.
xxxx for the Sangguniang Panlalawigan’s concurrence.
2. Immediately thereafter, or on August 7, 2019, the Sanggunian invited Atty. xxxx
before the plenary to answer
3. On August 14, 2019, the august body approved Resolution No. 2019-10-061 denying
the Sanggunian’s concurrence on the appointment of Atty. xxxxx as Provincial
Department Head
4. On September 1, 2019, the Office of the Governor resubmitted to the Sanggunian the
appointment of Atty. xxxxx which was then later referred to the Committee on Civil
Service
5. The Committee on Civil Service called for a Committee Hearing on September 25,
2019. In attendance to said hearing are representatives from the Civil Service
Commission

RECOMMENDATION:

FOREGOING CONSIDERED, this Committee hereby recommends the passage of a Resolution

concurring the appointment of Atty. xxxxxx as the Provincial Legal Officer of the Provincial
Government of xxxxxx.
