 ORDINANCE NO. 00__-2019

AN ORDINANCE PROHIBITING AND PENALIZING ANY PERSON, NATURAL OR JURIDICAL, FROM CAUSING
OBSTRUCTION/S ON STREETS, SIDEWALKS, AVENUES, ALLEYS, BRIDGES, PARKS AND OTHER SIMILAR PUBLIC
PLACES IN BARANGAY POBLACION.

SECTION 1. TITLE. This Ordinance shall be known and cited as the “Anti-Street Obstruction Ordinance of
Barangay Poblacion”.

SECTION 2. SCOPE OF APPLICATION. This Ordinance covers all kinds of obstructions on the streets and
other public places in Barangay Poblacion committeed by individuals, entities and other
associations other than those obstructions committed by persons while driving or operating
motor vehicles and all other forms of conveyances.

SECTION 3. PROHIBITION. It is prohibited and considered unlawful for any person or group of persons,
entity or company to obstruct the free flow of people, goods and vehicles and illegal
structures through the Barangay Roads network by using, utilizing or otherwise appropriating
ab any street, sidewalks or pedestrian walkway, avenue, alley, bridge, park and other public
place or portion thereof for commercial or personal purposes. The prohibition includes all
kinds of obstructions and is not limited to the following;

 Conduct of family gatherings/celebration, or parties and merry-making activities,

 Conduct or religious activities such as preaching, processions or holding a wake or
other community affairs like fiestas, games/amusement activities should be
coordinated with the Barangay Council and the traffic and Parking management
Department of Cavinti.

SECTION 4. It shall be unlawful for owners of residential and commercial establishments which are
located
Along National Road, Municipal Road to allow vendors, vehicle parking, and illegal structures
to
Use street frontage of thier establishments to sell thier goods, and other merchandise, and
Parking.

SECTION 5. PENALTIES. Violators of this Ordinance shall upon conviction be penalized as follows :
FIRST OFFENCE - Fine of Five Hundred Pesos (p500.00)
SECOND OFFENCE - Fine of Eight Hundred Pesos (P800.00)
THIRD OFFENCE - Fine of One Thousand Pesos or imprisonment of one month or
Both the discretion of the court.

SECTION 6. If the offender is an organization, partnership or corporation, the penalty provided for under
This ordinance shall be imposed upon the President, or General Manager or the Person-in-
Charge of the organization, partnership or corporation.

SECTION 7. REPEALING CLAUSE. All ordinances contrary to or inconsistent with this Ordinance are
hereby repealed or modified accordingly.

SECTION 8. EFFECTIVITY . This Ordinance shall take effect after a conduct of public hearing, upon the
approval of the Sangguniang Bayan and posted at three conspiscous places of the Barangay.
 BARANGAY ORDINANCE NO. 0_____-2019

AN ORDINANCE PROHIBITING THE USE OF PUBLIC STREETS, SIDEWALKS, AND OTHER PUBLIC PLACES OR
PORTIONS THEREOF AS GARAGE FOR PUBLIC UTILITY VEHICLES.

BE IT ORDAINED by the Sangguniang Barangay of Poblacion Cavinti, Laguna In session

assembled:

SECTION 1. SCOPE AND COVERAGE. The motor vehicle envisioned under the provisions of this Ordinance
Are jeepneys and tricycles under public utility denominations including passenger jeepneys
and
Motorized tricycles for hire.

SECTION 2. The use of public streets, sidewalks, alleys, and any other public place like plaza, park, or
other recreational area, or portion thereof, as garage for public utility vehicles is prohibited.

SECTION 3. Any person found using and/or otherwise converting any street, sidewalks, alley and any
other public place such as plaza, park, or other recreational areas, or portion thereof, as garage for
a
Public utility vehicle enumerated in Section 1 hereof shall, upon conviction, be punished with
A fine of not less than Five Hundred Pesos(P500.00) but not exceeding One Thousand Pesos
(P1,000.00) or imprisonment of not less than two(2) months, or upon the discretion of the
court

SECTION 4. NO CONTEST PROVISION. Any person caught wiolating the provison of this Ordinance who
does not want to contest the apprehension shall, prior to the filing of formal charges, be
allowed to pay the prescribed minimum fine with the Barangay Treasurer.

SECTION 5. Any person found violating the Ordinance Two(2) or more times shall not be allowed to avail
of the No Contest provision.

SECTION 6. EFFECTIVITY. This Ordinance shall take effect after a conduct of Public Hearing and
approval of Sangguniang Bayan.

SAPAGKAT, matapos maideklara ang kasarinlan ng Pilipinas sa mga kastila at sa panahon ng pang-
aagaw ng mga bagong imperyalistang Hukbong Amerikano na si Don Braulio V. Villanueva na naging
katipunero at sumabak sa digmaang Filipino-Amerikano at naging resulta ng kasarinlan ng Pilipinas;

SAPAGKAT, bilang pagkilala sa kanyang ambag-kontribusyon upang maging Malaya sa mga dayuhan
at hindi natinag sa kabila ng kaguluhang idinulot ng giyerang Filipino-Amerikano;

SAPAGKAT, ayon sa tala ng Pamahalaang Probinsyal ng Laguna siya rin ay nagsilbing kalihim ng
Dakilang Gobernador Hen. Juan Cailles;

Cavinti, ang Paaralang Elementarya ng Burol ay naitatag, napunuang itayo ang Social Hall, at kasalukuyang

rebulto sa gitnang plaza sa pamamagitan ng ambagan ng mga baryo na pinangunahan ng Presidnete
Municpal Braulio Villanueva;

SAPAGKAT, ayon sa datus ng ating Pamahalaan o Lokal na Sanggunian ng Bayan ng Cavinti ay walang
tala na ang Daang Bukal(Bukal Road) ay siyang ipinangalan doon;

SAPAGKAT, ang daang Bukal sa ngayon ay nasasakupan ng Barangay Poblacion at/ngunit bago pa
sumapit ng Baryo ng Bukal ay ang Baryo ng Sisilmin o sinaunang ULAPA kung tawagin;

SILANG AY PANGALANANG KALYE PEDRO V. VILLANUEVA BILANG PAGKILALA SA KAUNA-UNAHANG
PRESIDENTE MUNICIPAL NG BAYAN NG CAVINTI.

SAPAGKAT, matapos maideklara ang kasarinlan ng Pilipinas sa mga kastila at sa panahon ng pang-
aagaw ng mga bagong imperyalistang Hukbong Amerikano na si Don Pedro Villanueva na isang huwes na
siya ring Presidente ng Katipunan dito sa ating Bayan ng Cavinti ay patuloy pa rin siyang namuno upang
ipaglaban ang kasarinlan;

SAPAGKAT, bilang pagkilala sa kanyang ambag-kontribusyon upang maging Malaya sa mga dayuhan
at hindi natinag sa kabila ng kaguluhang idinulot ng giyerang Filipino-Amerikano;

SAPAGKAT, ang daang Bagong Silang kung tawagin sa kasalukuyan ay walang ganap na basehan o
batayan ng pagkakapangalan na ito naman ay nasasakupan ng Barangay Poblacion na kung saan nanirahan
si G.Pedro Villanueva;

SAPAGKAT, ayon sa datus ng ating Pamahalaan o Lokal na Sanggunian ng Bayan ng Cavinti ay walang
tala na ito ay pinangalanan ng Bagong Silang;

SAPAGKAT, alinsunod din sa patakaran ng Pambansang Surian ng Kasaysayan na ang isang Lokal na
Sanggunian ay maaari ding magpangalan o magsuhistyon na ang naturang lugar ay kinakailangang ipangalan
sa isang pinagmulan o taong naglingkod din sa pamayanan;

KUNG KAYA’T, DAHIL DITO, matapos ang isang pag-aaral na isinasang-ayon din sa daloy ng
kasaysayan ay inirerekomenda ni Punong Barangay Romel J. Villanueva na iminungkahi naman ni

at pagkilala sa kauna-unahang Presedente Municipal ng Bayan ng Cavinti.

IPINASIYA RIN, na padalhan ng sipi ng Kapasiyahang ito ang Kgg. Sangguniang Bayan ng Bayan ng
Cavinti para sa kanilang kaalaman, gabay, tala, pag-aaral at pagpapatibay.
