HANDLING DISCIPLINARY CASES: MAJOR OFFENSES (FINAL APPEAL)

1.0. Purpose
To establish procedure of handling disciplinary cases which falls under major offences.

2.0. Scope
This procedure is for staff who are involved in maintaining discipline towards students.

3.0. Responsibilities

3.1. Appeal Committee (AC) – A committee appointed by the Chief Executive Officer to
manage appeal issues by the student pertaining to the sanction decided by the DC.

3.2. Disciplinary Appeal Committee Secretariat (DAS) – Head of Student Affairs


Department to implement disciplinary action.

3.3. Chief Executive Officer (CEO) – To decide make decision based on recommended
review by the Appeal Committee on the previous punishment.

4.0. Definition

4.1. Major offenses – Offenses which does not fall under compoundable offenses. Major
offenses: (i) Indecent behaviour, (ii) Actions that endanger own life or others, (iii)
use of violence i.e. bully, blackmail, molestation, ragging, fist fight, quarrelling etc.,
(iv) Drugs and Poison i.e. possesses, supply or distribute, (v) Possesses weapons or
explosive subtances, (vi) Be involved in activities or displaying any behaviour
including political rallies and demonstration, (vii) Become a member of illegal group
or gangs, (viii) Police case, and other violation which deemed dangerous and could
ruin Kolej UNIKOP’s good name.

4.2. Disciplinary Actions for major offense - Disciplinary actions that can be taken for
major offense (i) Fine not exceeding RM500, (ii) Payment for cost and damage, (iii)
Withdrawal of using Kolej UNIKOP’s facilities, (iv) Community service not exceeding
100 hours, (v) Suspension and (vi) Expulsion from Kolej UNIKOP

5.0. Procedure

5.1. A student who is not satisfied with the disciplinary action or punishment served on
him by DAC can appeal in writing to the CEO within 7 days from the date of receipt
of the letter conveying the decision.

5.2. A student who is not satisfied with the disciplinary action or punishment
(suspension and dismissal) served on him by DAC can appeal in writing to the CEO
of Kolej UNIKOP within 7 days from the date of receipt of the letter conveying the
decision.

5.3. When an appeal is received by the CEO, he/she must instruct the DAS to prepare all
supporting documents related with the case and conduct the appeal meeting within
5 working days.

5.4. The CEO will make a decision based on the recommended review by AC on the
previous punishment.

5.5. The decision made by the CEO is final.
