HANDLING DISCIPLINARY CASES: MAJOR OFFENSES (APPEAL)

1.0. Purpose
To establish procedure of handling disciplinary cases which falls under major offences.

2.0. Scope
This procedure is for staff who are involved in maintaining discipline towards students.

3.0. Responsibilities

3.1. Disciplinary Authority (DA) – Staff who are given the authority to carry out
discipline procedure.

3.2. Disciplinary Committee (DC) – A committee appointed by the Chief Executive


Officer and chaired by Registrar / Head of Academic / Head of Student Affairs to
handle student’s disciplinary cases and to make relevant decisions pertaining to
punishments and actions.

3.3. Disciplinary Committee Secretariat (DCS) – Student Affairs Department to initiate


disciplinary action for hearing of Serious Offenses and to handle cases of Minor
Offenses

3.4. Appeal Committee (AC) – A committee appointed by the Chief Executive Officer to
manage appeal issues by the student pertaining to the sanction decided by the DC.

3.5. Disciplinary Appeal Committee Secretariat (DAS) – Head of Student Affairs


Department to implement disciplinary action.

4.0. Definition

4.1. Compoundable offenses – Offenses which falls under compoundable offenses: (i)
Attire (ii) Personal hygiene and grooming, (iii) Smoking and vaping, (iv) Making
noise which cause disturbance, (v) Campus cleanliness (vi) Failing to produce matric
card and (vii) Traffic.
The violation is clear, does not need further investigation or refer to the Disciplinary
Committee.

4.2. Major offenses – Offenses which does not fall under compoundable offenses. Major
offenses: (i) Indecent behaviour, (ii) Actions that endanger own life or others, (iii)
use of violence i.e. bully, blackmail, molestation, ragging, fist fight, quarrelling etc.,

(iv) Drugs and Poison i.e. possesses, supply or distribute, (v) Possesses weapons or
explosive subtances, (vi) Be involved in activities or displaying any behaviour
including political rallies and demonstration, (vii) Become a member of illegal group
or gangs, (viii) Police case, and other violation which deemed dangerous and could
ruin Kolej UNIKOP’s good name.

4.3. Disciplinary Actions for major offense - Disciplinary actions that can be taken for
major offense (i) Fine not exceeding RM500, (ii) Payment for cost and damage, (iii)
Withdrawal of using Kolej UNIKOP’s facilities, (iv) Community service not exceeding
100 hours, (v) Suspension and (vi) Expulsion from Kolej UNIKOP

5.0. Procedure

5.1. Upon receiving letter informing the DC decision, the accused student is given seven
(7) days to make an appeal to the AC regarding the decision made by the DC.

5.2. AC may reconsider the decision made by the DC.

5.3. In the event, the sanction is suspension or dismissal, the findings by DC during the
trial shall be forwarded to the AC. AC may proceed with DC recommendations or
otherwise recall all proceeding records for examination and recall witnesses and
DCS for confirmation.

5.4. Upon satisfaction, AC shall decide to dismiss or recommend other punishment to DC.
All AC’s findings and decision shall be recorded by the DAS.

5.5. In the event AC endorsed the decision by DC, AC shall instruct DAS to continue with
disciplinary action. DAS will need to inform AC decision to DC and Chief Executive
Officer.

5.6. DAS inform the accused student and his/her parents/guardian of the AC decision.

5.7. DAS record case file and AC decision.
