IV. Legal Aspect

Business Permit

Barangay Permit is one of the most basic requirements for a business.

After registering your business name with the DTI is to register your business and get a permit
from the Barangay, the smallest and most basic political unit in the country which has the direct
contact with each member of the community.

Requirements:

 Latest Community Tax Certificate (Cedula)


 DTI Business Name Registration
 Barangay Business Permit Fee (Php 500 for QC)
 Barangay Business Permit Clearance Procedures

Procedure:

Once you have these documents and fees at hand, just pay a visit to your local Barangay Hall
or the Office of the Barangay Captain. Tell them that you need to get a Barangay Business
Permit and they will assist you in processing that. Usually, this type of transaction is fast and
easy. In fact, you can probably expect to get done with it in only a few minutes.

Mayor’s Permit

Securing a Mayor‟s Permit is one of the requirements for every business or company to operate
in the Philippines. Local Government Units (LGUs) can be cities or municipalities. Each
municipality has different procedures depending on the ordinance of the city or municipality.

A Business Permit is referred to as a Mayor‟s Permit, because it is processed at the City Hall –
the office of the mayor. Securing a business permit from the Mayor‟s Office can only be done
after accomplishing two other registrations first:

1. The registration of your business with the Department of Trade and Industry or DTI (for
single proprietorship) or with the Securities and Exchange Commission or SEC (for
partnership or corporation); and,
2. Securing a Business Barangay Clearance.
Requirements for Mayor‟s Permit:

1. Certification – either one of the following:


 DTI Business Name Certificate; or,
 SEC Articles of Partnership; or,
 SEC Certificate of Incorporation
2. Barangay Clearance / Permit
3. Authorization letter of owner with ID
4. Contract of Lease or Land Title / Tax Declaration
5. Sketch of Location
6. Occupancy Permit
7. Locational Clearance
8. Public Liability Insurance
9. Community Tax Certificate (Cedula)
10. Fire Permit
11. Sanitary Permit

The most crucial among this list are items 3 – 6, which are obtained “outside” the registration
process. They are almost always provided by the building admin / owner of the property.

Procedure for securing Mayor‟s Permit (Quezon City):

1. Apply for a barangay clearance at the barangay where your business will be located.
2. Go to the Business One Stop Shop (BOSS) at the ground floor of the Civic Center
Building A, Quezon City Hall compound.
3. Bring with you the following documents:
 Barangay clearance (original copy)
 Business registration with the Department of Trade and Industry (DTI), if single
proprietorship; or with the Securities and Exchange Commission (SEC), if
partnership or corporation
 Contract of lease (if renting business area), title to property & tax declaration(if
owner of business area)
 Location plan/ site map (for the locational clearance)
 For the filer, please bring your identification card. If you are not the business
owner, bring an authorization letter from the owner.
4. Go to the BOSS business registration window. Be ready to provide the person at the
counter with the following information:
 Business type(single proprietorship? Partnership? Corporation?)
 Nature of business activities
 DTI or SEC number
 Name of business are registered in either the DTI or SEC
 Owner's address
 Name of the new business's president and treasurer
 Tax identification number (TIN) of the business
 Name and designation of the authorized representative(if applicable)
 Contact numbers
 Employer's Social Security Services (SSS) number, if the business has
employees
 If the business place is rented: indicate sice when the place has been rented and
from whom it is renting

The BOSS personnel will input the above information on computirized form and verifies from the
applicant the correctness of all information. The BOSS personnel prints out the filled up form
and the assesstment fee, and gives these to the appicant. The applicant signs the form and
goes tio the cashier.

5. Pay at the BOSS Cashier, the assessed amount.


6. If your business is minimally regulated (offices such as lawfirms etc.), you will get your
Mayor's Permit right after payment.

Sanitation Permit

Sanitary Permit is a certification in writing of the Municipal Health Officer issued to


establishment complies with the existing minimum sanitation requirements upon evaluation or
inspection conducted in accordance with Presidential Decrees No. 522 and 856 and local
ordinances.

Steps for the issuance of the Sanitary Permit (2016):

1. All applicants of establishments (owner / designated representatives/ liaison officer)


must proceed to the Quezon City Health Department (QCHD) Annex Building, 2nd floor,
Sanitation Division.
2. Present IDENTIFICATION CARD issued by the establishment or company that you are
applying the Sanitary Permit for.
In the absence of Identification Card issued by the establishment, any ID shall be
accepted provided that the applicant bears an authorization letter from the owner
formally designating the applicant to apply on behalf of the company/ establishment.

3. Submit the following documents to the Health & Permit Section, 2nd Floor, QCHD
Annex Building for the issuance of the TRANSACTION NUMBER(The Transaction
Number is the basis for the issuance of the Mission Order to the Sanitation Inspector to
conduct inspection/re-inspection):
4. Applicants will be issued Form 1 which contain the following information:
 Date of Application
 Transaction Number
 Name of Establishment
 Address of establishment
 Name of the Owner
 Designated Representative (liaison officer)
5. The Sanitation Inspector will conduct the inspection upon receipt of Mission Order
issued by the City Health Officer.
6. No inspection shall be conducted and accepted without a MISSION ORDER. All details
of requirements shall be discussed by the Sanitation Inspectors during their
inspection/re-inspection visits.
7. Once the applicant-establishment has been issued the FINAL INSPECTION REPORT
with ANNOTATION “FOR SANITARY PERMIT PROCESSING,” the applicant-
establishment must submit the following in a folder:
 Final Inspection Report with annotation “FOR SANITARY PERMIT PROCESSING”
 Photocopies of current (2016) Health Certificates of all personnel (medical & non-
medical) /professional & non-professional staff
 „Microbiological‟ Water test results (original) done by the “RECOGNIZED “water
laboratory by the Quezon City Government thru the Quezon City Health Department
(see website for the updated list of “RECOGNIZED” water laboratory from January
to March 2016)
 Pest Control Service Report Rendered for the current year
 Must contain the chemicals used
 If Pest Control Service Provider is located within Quezon City, attach 2015
Sanitary Permit of that provider issued by the Quezon City Health Department
which will be accepted only from January to March 2016, unless it is renewed
for 2016
 If Pest Control Service Provider is located OUTSIDE of Quezon City, attach
2016 Sanitary Permit issued by the Local Government concerned
8. Other Requirements shall be likewise required, which will depend on the nature of
business, such as:
 Environmental Clearance issued by the EPWMD , Quezon City Government
 Special Use Permits
 Hazardous Waste Generator ID (HWGI)
 Memorandum of Agreement with Hazardous Waste Transporter and Treater
 Certificate of Treatment
 Licenses /Permits/ Permit to Operate issued by national agencies (DOH,
Professional Regulation Commission, DENR, LLDA , and others)
9. In case of incomplete requirements, the applicant–establishment shall be notified of any
deficiencies or for purposes of verification.
10. Complete requirements shall be reviewed by the Head of the Sanitation Division and
final recommendation shall be made to the City Health Officer III for the issuance of
Sanitary Permit.
11. The Sanitary Permit shall be signed–out only by the authorized representative of the
applicant-establishment.

Fire and Safety Inspection

Fire safety inspections should be conducted as a pre-requisite to grants of permits and/or


licenses by local governments or other government agencies.

1. Inspection Process:

1. Inspections should be done at least once a year and every time the owner, administrator
or occupant shall renew his/her business permit or permit to operate.
Building plan review
 Building owners/occupants are required to submit 6 sets of building plans and
other pertinent documents to the City/Municipal Fire Marshal (Sec. 9.0.2.1 a)
 Upon assessment, buildings owners/occupants will be asked to pay Fire Code
fees (Sec. 9.0.2.1 a)
 Submit the Fire and Life Safety Assessment Report 1 (FALAR)
 City/Municipal Fire Marshal will either approve or disapprove the evaluated plans
together with the Fire Safety Checklist (FSC) and the approved/disapproved Fire
Safety Evaluation Clearance (FSEC)
2. Inspection during construction
3. Inspection after completion of construction
 Submit the Fire and Life Safety Assessment Report 2 (FALAR)
4. Business and routine inspection
 Submit the Fire and Life Safety Assessment Report 3 (FALAR)

2. Required Papers/Permits:
 Fire and Life Safety Assessment Report (FALAR) 1: Documentation on Fire and Life-
Safety Features of the Facility – prepared by the Architect and his Fire Protection
Consultant
 Fire and Life Safety Assessment Report (FALAR) 2: Documentations submitted by the
Contractor/s and the Construction Manager certifying that the construction was in
accordance with the FALAR 1 and authorized changes
 Fire and Life Safety Assessment Report (FALAR) 3: Documentation on the required
periodic maintenance of the fire and life-safety features of the facility – prepared by the
building owner, his fire safety officer/authorized representative
 Fire Insurance Data
 Fire Safety Inspection Certificate (FSIC) – pre-requisite for issuance of Business or
Mayor‟s permit, Permit to Operate, Occupancy Permit, PHILHEALTH Accreditation for
Hospitals, DOH License to Operate and other permits or licenses
 Building Permit
 Occupancy Permit

Social Security System (SSS)

SSS also known as Social Security System in the Philippines is so important not only in social
security but also for retirement. It gives benefits like maternity benefits, sickness, disability,
loans, funeral, retirement and a lot more. To become eligible for benefits, you must maintain
your active membership with SSS and maintain your contributions. As of now, the minimum
contribution in order to be eligible for retirement pension is 120 months.

To avail the other benefits, maintain an active membership by paying monthly. Also never miss
a month to avoid penalties.

Requirements in getting SSS Number:


 Take note that SSS Number is different with SSS ID Card or UMID. SSS Number is the
per-requisite to be an SSS member. To get this number you need:
 SSS E1 Form – fill this out properly and correctly
 Birth Certificate – original and photocopy
 Valid IDs or any among the list of supporting documents – original and photocopy
 An email address for your SSS online account

Procedures in getting SSS Number:

1. Fill up your personal details and information on the SSS E1 form. You can get the form at
the SSS branch near you. You can also download it online if you want.
2. Fall in line at the SSS branch near you and wait for your turn. Submit your E1 form and
attach your photocopies of valid IDs and birth certificate.
3. Wait for your personal copy of E1 form. SSS will issue your SSS Number at the upper part
of E1 form. Keep this for life because it is so important. Never lose it because we can only
have ONE SSS Number for life.

PhilHealth

PhilHealth is a government-mandated health insurance program. It stands for Philippine Health


Insurance Corporation. It is our national health insurance program that Filipino citizens can (and
should) enroll in.

Established in the early 1960s, PhilHealth is a government-owned and government-controlled


health care program that aims to provide and ensure the following:

1. Health insurance coverage for all Filipinos


2. Health care services that are of quality and affordability
3. Responsible management of its economic resources.

Who are qualified?

1. Employed - Employees that work for private and government sectors, as well as
household employees and sea-based OFWs whose premiums are jointly covered by
both employee and employer are qualified.

2. Overseas Workers - Land-based overseas contract workers whose premiums are paid
before their departure.
3. Individuals - Self-practicing or self-employed professionals who contribute to the
program voluntarily.

4. Sponsors - Families that are less fortunate and can‟t afford their own insurance can
be covered by National Government Units, Local Government Units, private individuals,
and companies. Families and individuals belonging to the lowest 25% of the Philippine
population are also qualified for this program.

5. Lifetime - Having reached the age of retirement and making at least 120 months of
contribution, retirees and pensioners are entitled to a lifetime coverage.

Benefits:

1. Inpatient

When a member or a dependent is confined (for no less than 24 hours), they are subsidized for
the following:

 Room and board


 Services of health care professionals
 Diagnostic, laboratory, and other medical examination services
 Use of surgical or medical equipment and facilities
 Prescription drugs and biological
 Inpatient education packages

Taxpayer Identification Number (TIN)

A Taxpayer Identification Number (TIN) is an identification number used by the Internal


Revenue Service (IRS) in the administration of tax laws. It is issued either by the Social Security
Administration (SSA) or by the IRS. A Social Security number (SSN) is issued by the SSA
whereas all other TINs are issued by the IRS.

Who can apply for a TIN?

1. Self-employed and mixed income individuals


2. Individuals or employees earning purely compensation income
3. Corporations, partnerships, including government agencies and instrumentalities (GAI),
Local Government Units (LGUs)
4. One time taxpayers with no previously issued TIN
5. Persons registering under Executive Order 98 (those securing TIN to transact with
government offices.
6. Estates and trusts
7. Non-resident citizens/Overseas Contract Workers/Seamen earning purely foreign-sourced
income

The BIR Forms for TIN application:

These are the corresponding BIR Forms that you need to fill up when applying for TIN,
depending on how you are classified. You need to bring this together with the documentary
requirements below.

 BIR Form 1901 – Application for Registration for Mixed Income Individuals, Estates and
Trusts
 BIR Form 1902– Application for Registration for Individuals Earning Purely
Compensation Income and Non Resident Citizens/Overseas Contract Workers/Seamen
Earning Purely Foreign Sourced Income
 BIR Form 1903– Application for Registration for Corporations/Partnerships
(Taxable/Non-Taxable), including Government Agencies and Instrumentalities, and
Local Government Units
 BIR Form 1904– Application for Registration of One Time Taxpayer And Persons
Registering Under Executive Order 98

Requirements for Corporations and Partnership including GOCCs, GAI and LGUs:

 Filled-up BIR Form 1903


 Certificate of Registration issued by the Securities and Exchange Commission (SEC);
articles of incorporation/partnership
 Mayor‟s Permit
 Other documents which may include the following, if applicable:
 Contract of lease
 Certificate of authority if Barangay Micro Business Enterprise registered
 Franchise agreement
 License to do business in the Philippines, if a resident foreign corporation
 Proof of registration from economic development authorities
 For cooperatives, a copy of Certificate of Registration from Cooperative Development
Authority
 For GOCCs, GAI and LGUs; copy of the Unit of Agency‟s Charter

Procedurein applying TIN for Corporations and Partnership including GOCCs, GAI and LGUs:

1. Fill up BIR Form 1903 and submit it together with the documentary requirements as
stated above, to the Revenue District Office (RDO).
2. Pay the Annual Registration Fee of Php500 at the Authorized Agent Banks of the RDO.
3. Pay the Documentary Stamp Tax (Php15) and other certification fees as may be
deemed necessary.
4. Wait for the RDO to issue your Certificate of Registration.
5. For corporations, Documentary Stamp Tax on the Articles of Incorporation must be paid
within 5 days after the close of the month following the date of issuance of the same
Articles.

Note: Corporations, partnerships and joint ventures shall file the application before
commencement of the business.

PAG-IBIG

PAG-IBIG is an acronym which stands for PagtutulungansaKinabukasan: Ikaw, Bangko,


Industria at Gobyerno.

To this day, the Pag-IBIG Fund continues to harness these four sectors of the society to work
together towards providing Fund members with adequate housing through an effective savings
scheme.

1. The Home Development Mutual Fund (HDMF)

More popularly known as the Pag-IBIG Fund, was established to provide a national savings
program and affordable shelter financing for the Filipino worker. The Fund offers its members
short-term loans and access to housing programs.

monthly contributions, employer‟s counterparts, and earned dividends. This service financially
assists retired and Filipino senior citizens, who deserve to enjoy the fruits of their years of hard
work.

dividends will also increase. For 2016, the total dividend that every contributing member will
earn is pegged at 4.8 percent interest per annum.

Basic Requirements:

 Accomplished Buyer‟s Information Sheet (2 copies) with recent 1x1 ID photo (2 copies)
 One (1) valid ID (Photocopy, back to back) of Principal Buyer and Spouse, Co-Buyer
and Spouse,
 If applicable Proof of Income for (any of the following):
 Owned Business Income Tax Return (ITR)
 Audited Financial Statements
 Official Receipt of Tax Payment from bank supported with DTI Registration and
Mayor‟s Permit/Business Permit Commission Base Commission Vouchers reflecting
the issuer‟s name and contract details (for the last 12 months)
 Drivers Certified True Copy of Transport Franchise issued by appropriated
government agency (LGU for tricycles, LTFRB for other PUVs)
 Foreign Remittances and Pensions of Bank Statements or passbook for the last 12
months (in case income is sourced from foreign remittances, pensions, etc.)
 Rental Payments Copy of lease Contract and Tax Declaration (if income is derived
from rental payments) Sari-sari Store/Mini Groceries, Sub-Contractor, On call
Maintenance, Technician Brgy. Certificate/Clearance Properly Accomplished
Certificate of Engagement duly notarized
