Purpose: To prove that:

1. The accused committed the offense charged, namely challenging

private complainant Erick Malijan to a duel;
2. Also that Reynaldo Taneo committed slight physical injuries and
unjust vexation against private complainant Erick Malijan, who filed a
separate case against Mr. Taneo; and
3. Other matters relevant to this case.

I, PATRICK SORIA, of legal age, Filipino citizen, after having been

sworn in accordance with law, hereby depose and state that:
 a. I shall truthfully answer the following questions to be asked to
me; and
b. I am fully conscious that I am under oath, under the pain of
criminal liability for false testimony or perjury.

In view thereof, I hereby give my answers to the following questions

to wit:

answers in the vernacular)

1. Do you know Erick Malijan and Gilbert Solares? – Yes sir.

2. How do you know them? – Kapitbahay ko po sila.
3. Where? – Sa Uranus street, Barangay San Juan, Cainta, Rizal po.
4. How long have you been neighbors? - 3 years po, since 2015 up to
present.
5. Where were you on 9 March 2017- Nasa bahay po, bandang 730am
narinig ko si Mr. Solares nagsabi “Eric lalaki ka ba talaga? Kung lalaki
ka suntukan tayo.”
6. Then what did you do? – Sumilip ako sa pintuan namin, nakita ko
sina malijan and solares, magkaharap.
7. How far were you? - 4-5 meters away po.
8. Then what happened? – Narinig ko si Mr. Malijan sabi “Wala na tayo
dapat pag usapan, kasi nag usap na tayo sa barangay kagabi.”
Tapos pumasok si Mr. Malijan sa bahay nila and sinara ang gate.
9. Then what happened? - Napansin ko hindi mapakali si Mr. Solares,
tapos umalis si Solares naka motor. Tinigil ko na pagsilip sa pintuan
at pumasok ako ng bahay
10. Then what happened? – Around 8am may kumalampag sa gate nina
Mr. Malijan, sumilip uli ako sa pintuan, nakita ko si Mr. Rey Taneo,
kasama si Solares at higit limang tanod, at narinig ko si Mr. Taneo
sumigaw “Hoy bumaba ka dito! “ patuloy kalampag ng gate.
11. To whom was he shouting? Kay Mr. Malijan.
12. How did you know? – Kasi si Mr. Taneo nasa tapat ng gate ni Mr.
Malijan.
13. Then what happened – Bumaba si Mr. Malijan, binuksan gate nila ng
dahan dahan, sumilip si Mr. Malijan tapos hinila ni Mr. Taneo si Mr.
Malijan palabas.
 14. Then what happened? - Sabi ni Mr. Taneo “ Kabagobago mo dito
siga ka na! Gusto mo ipabugbog kita dito sa mga bataan ko?”
15. Then what happened? - Inutusan ni Mr. Taneo si Mr. Solares na
kumuha ng camera para I video sila. Pumasok si Mr. Solares sa
bahay nila para kumuha ng camera, bumalik siya may dalang
digicam.
16. Then what happened? - Nilalapit ni Solares yung digicam sa mukha
ni Mr. Malijan habang minumura ni Mr. Taneo si Mr. Malijan.
17. Then what happened? – Sa takot ko pumasok ako sa bahay
18. Do you see the accused Solares and Taneo in this court? Pls point
them out.
