ORDER DENYING MOTION TO AMEND

The Motion to Amend the Indictment filed by the State of Alabama is DENIED. Said
Denial is based on the Defendant's declining to consent to the Motion, which, therefore,
leaves the Court with no authority to amend the indictment.

Based on the assertions in the State's Motion to Amend the Indictment, the Court finds
that a Material Variance exists as related to the improper decedent being listed in
Counts 1 and 2 of the Indictment.
