PARENT’S CONSENT AND WAIVER

In compliance with Republic Act No. 10173, otherwise known as the “Data Privacy Act,” Smart
Communications, Inc. seeks your consent to collect and use your minor child’s personal data (Name,
Mobile Number, Address, Email, Birthdate, and School region and name) as part of Smart
Communications, Inc.’s (“SMART”) Balik Tuition Promo (the “Promo”).

SMART will collect and disclose your child’s personal data to process and facilitate your child’s
registration and participation in the Promo. Please note that in case your child wins any of the Promo
prizes, his/her personal data will also be shared with the Department of Trade and Industry (“DTI”) as
part of the DTI’s requirements for the holding of sales promotions. We have also engaged the services of
MVP Rewards and Loyalty Solutions, Inc. for the development, operations, and maintenance of the
Promo system, which will require their access to your child’s Personal Data in order for them to run the
Promo on our behalf. MVP Rewards and Loyalty Solutions, Inc. may process your child’s Personal Data
only for this purpose.

We would like you to know that your child’s personal data will be kept in our records for the
duration of the Promo, and for a maximum of 60 days after. If you have any further questions or
complaints about the use of your child’s personal information, please write us at
dataprivacyoffice@smart.com.ph.

read the above information and understand the reasons for the collection of my minor child’s personal
data and the ways in which the data may be used, processed, disclosed, and retained and I agree to said
usage, processing, disclosure and retention.

By signing this form, I hereby provide consent to the collection, retention, processing, and
disclosure by SMART of my minor child’s personal data in accordance with the Data Privacy Act, its
implementing rules and regulations, the relevant issuances of the National Privacy Commission, and
applicable privacy policies.

I shall hold SMART, its officers, directors, stockholders, employees, consultants, and other parties
acting for and in behalf of SMART free and harmless from all claims, suits, charges, fees, damages or
liabilities arising from my child’s participation in the Balik Tuition Promo.
